Abstract
Aktivno sodelovanje v aktualnih geopolitičnih procesih na pod- ročju skupne zunanje in varnostne politike EU terja pravočasno in učinko- vito sprejemanje odločitev držav članic EU. Prispevek obravnava možnosti odstopa od soglasja in uporabe kvalificirane večine po trenutno veljavni pravni ureditvi EU, pri tem pa opozarja na položaj malih držav članic EU, vključno s Slovenijo. Poudarja pomen pravilne razlage veljavnih kriterijev, pri čemer izhaja tudi iz prakse Sodišča Evropske unije. Poda tudi predlog, kako bi lahko voljo malih držav za uporabo kvalificirane večine v prihod- nje morda okrepili s spremembo kriterijev za dosego blokirajoče manjšine ob morebitnih spremembah pravne ureditve EU.

Title:Qualified decision-making in the common foreign and security policy and small states in the EU
Abstract:
Active participation in current geopolitical processes within the EU’s Common Foreign and Security Policy calls for timely and efficient decision-mak- ing by EU Member States. The article examines the possibilities of derogating from unanimity and the use of qualified majority voting under current EU law, while drawing attention to the position of small EU Member States, including Slovenia. Highlighting CJEU case law, it underlines the importance of a proper interpreta- tion of applicable criteria. It includes a proposal on a potential future strength- ening of small States’ readiness to use qualified decision-making by adjusting the criteria for a blocking minority in the case of future amendments to EU law.
