The procedure for issuing a building permit is a complex process which, because of the search for a balance between private and public interest, belongs to the most demanding administrative procedures. The question of how to shorten the time aspect of the building permit issuance procedure has not only been a question but a challenge for the past 30 years, both for the profession and the legislative body. The legal timeframe has not changed over the years, the procedure has changed in the hope of a greater effect in terms of a more seamless, efficient and thus faster procedure for issuing a building permit.
The purpose of the master's thesis is a detailed analysis and at the same time an evaluation of the provisions of the new sector-specific Building Act with the aim of determining whether the new legal solutions can impact the pace of resolution of procedures for issuing building permits in the coastal area of three administrative units, where the length of procedures is the most excessive. In this master's thesis there are applied the following methods of research: description method, historical method, compilation method, comparative method, and deduction method.
The findings suggest that the solutions provided for in the new legislation do not affect and have no effect on the time required for the building permit to be issued. Regardless of the solutions provided for, the employees of the coastal administrative units consider that the biggest problem is the lack of expertise, i.e. the lack of competence to manage such a procedure. The greatest hope is placed in the new eGraditev (eConstruction) information system, which is expected to provide greater legal security for investors and more efficient management of human resources.
This master's thesis is focused on researching the impact of the provisions of the new Building Act on the time aspect of the procedure for issuing a building permit; the future impact of the eConstruction information system, both on employees and on investors; and the comparative aspect of the eConstruction information system in Croatia.
