The master's thesis deals with the issue of Slovenian civil procedural law, more specifically with the issue of disqualification of a judge in litigation, as reflected in the Slovenian case law from 2018 to the present day. The institution of disqualification of a judge essentially pursues, by its existence, the goal of an impartial court as one of the fundamental human rights of a procedural nature. It originates both at the international law level (6 ECHR) and at the national law level (23 U.S.C.). The master's thesis consists of two parts. The first part provides a theoretical introduction to the right to an impartial court, which is exercised through the institution of the disqualicfication, its meaning and the role it plays in judicial proceedings. The second part of master's thesis is devoted to an analysis of the case law, with an emphasis on the analysis of the ground of exclusion (iudex suspectus). In oher words: the master's thesis addresses the question of the ways in which Slovenian case law, in particular, interprets the statutory provisions of civil procedural law governing the disqualification of a judge, and thus implicitly guarantees to the parties to the impartiality of the judiciary, as a fundamental human right.
