Abstract
Finančna nedisciplina v današnjih časih v slovenskem prostoru in tudi širše predstavlja veliko težavo. Ko nekdo ne želi prostovoljno plačati dolga ali izpolniti drugih obveznosti, ima upnik za izterjavo in poplačilo dolžnikovega dolga več možnosti. Upnik lahko preda izterjavo dolga agenciji za izvensodno izterjavo ali pa se odloči za izterjavo po sodni poti, z izvršbo na pristojnem sodišču. Bistvo izvršilnega postopka je, da ima upnik v čim krajšem času poplačano svojo terjatev. Izvršilni postopek mora potekati hitro, učinkovito in pravilno. Stanje na področju vodenja izvršilnih postopkov na sodiščih se z leti izboljšuje, zlasti zaradi sprememb zakonodaje, reorganizacije poslovnih procesov in informatizacije izvršilnega postopka. Slovenci smo pregovorno navezani na nepremičnine, saj je lastništvo stanovanja ali hiše pomemben dosežek posameznika. Posledica tega je, da je izvršba na nepremičnino najbolj učinkovito izvršilno sredstvo za izterjavo dolga in da upnik s tem izvršilnim sredstvom najhitreje doseže poplačilo svoje terjatve. Izvedba elektronskih (spletnih) javnih dražb nepremičnin je dodatno olajšala postopek izvedbe in z njihovo uvedbo se je izboljšala tudi preglednost nad izvršilnim postopkom na nepremičnine dolžnika.

Title:Analysis of the performance of enforcement on the debtor's real estate
Abstract:
Financial indiscipline is nowadays a big problem in Slovenia and beyond. When someone does not want to voluntarily pay a debt or fulfill other obligations, the creditor has more options for collection and repayment of the debtor's debt. The creditor can entrust debt collection to an out-of-court collection agency, or he can decide to collect through court, with enforcement in a competent court. The essence of the enforcement procedure is that the creditor has his claim repaid in the shortest possible time. The enforcement procedure must be fast, efficient and correct. The situation in the field of enforcement proceedings in courts has been improving over the years, especially due to changes in legislation, reorganization of business processes and computerization of enforcement proceedings. Slovenians are proverbially attached to real estatebe, cause owning an apartment or house is an important achievement for an individual. The result of this is that real estate enforcement is the most effective enforcement tool for debt recovery and that the creditor can use this enforcement tool to achieve repayment of his claim the fastest. The implementation of electronic (online) public real estate auctions further facilitated the process of conducting public real estate auctions, and their introduction has also improved transparency over enforcement proceedings on the debtor's real estate
