The master's thesis deals with four central topics that arise when reviewing the regulation of real estate brokerage. It concerns the issue of payment for real estate brokerage, the issue of liability for damage and liability insurance, the issue of the duty of explanation of the real estate broker and the issue of actual costs incurred in connection with the provision of mediation services in real estate transactions.
Due to the increasing ability and willingness of individuals to change their place of residence in order to adapt to life changes and the increasing number of economic entities that need suitable premises to carry out their activities, the supply and demand for real estate is increasing, resulting in more and more real estate transactions. Most often, transactions take place on the secondary real estate market, where the central role is played by a real estate agent who performs business for a real estate company. It is an area regulated by the Act on Real Estate Brokerage (ZNPosr), the purpose of which is to protect the client and their interest, and to ensure that this is achieved to the greatest extent possible. In addition, to protect the position of third parties who conclude contracts, the subject of which are real estate, in the mediation of which real estate companies participate.
