Modeli inkriminacije prenašanja nalezljivih bolezni

Abstract
Epidemija virusa SARS-CoV-2 je ponovno aktualizirala vprašanje kazenskopravnega vidika prenašanja nalezljivih bolezni. Magistrsko delo vsebuje pregled različnih primerjalnopravnih ureditev inkriminiranja prenašanja nalezljivih bolezni in njihovo umestitev v različne primerjalnopravne modele. Modeli so (i) osebni poškodbeni, (ii) javni poškodbeni, (iii) osebni konkretno ogrozitveni, (iv) javni konkretno ogrozitveni in (v) javni abstraktno ogrozitveni model. Strogo teoretično bi bilo sicer mogoče oblikovati tudi osebni abstraktno ogrozitveni model, vendar pa se inkriminacije, ki bi jih bilo mogoče umestiti vanj, primerjalnopravno ne pojavljajo. Pri odločitvi o tem, v kateri primerjalnopravni model umestimo inkriminacije je treba opraviti analizo konkretne inkriminacije in ob ugotovitvi katera je tista dobrina, ki jo inkriminacija v večjem delu varuje in katera je prepovedana posledica, lahko le-to uvrstimo v konkreten model. Številne države poznajo več različnih kaznivih dejanj v povezavi s prenašanjem nalezljivih bolezni, saj se na takšen način zagotavlja celovitejše kazenskopravno varstvo. Kazensko pravo mora namreč zagotoviti tako varstvo osebnih dobrin, kot tudi dobrin splošnosti, to pa je najlažje dosegljivo na način, da se z določenimi inkriminacijami varuje življenje, telesna celovitost in zdravje, z drugimi pa javno zdravje. Prav tako magistrsko delo izpostavlja tudi pomanjkljivosti slovenske kazenskopravne ureditve varstva pred nalezljivimi boleznimi.

Title:Models of criminalization of transmitting infectious diseases
Abstract:
The outbreak of the SARS-CoV-2 virus has reinvigorated the question of the criminal law aspects of transmitting infectious diseases. This master's thesis provides an overview of various comparative legal frameworks for criminalizing the transmission of infectious diseases and their placement within different comparative legal models. The models considered are (i) personal injury-based, (ii) public injury-based, (iii) personal concrete endangerment-based, (iv) public concrete endangerment-based, and (v) public abstract endangerment-based models. While it is theoretically possible to develop a personal abstract endangerment-based model, comparative legal analysis shows that such incriminations do not appear in practice. In determining the appropriate comparative legal model for a particular incrimination, an analysis of the specific offense is necessary to identify the protected interest and the prohibited consequence. Many countries recognize multiple offenses related to the transmission of infectious diseases to ensure comprehensive criminal protection. Criminal law must provide protection for both personal interests and public interests, which can be achieved by criminalizing acts that endanger life, bodily integrity, health, and public health. Additionally, the master's thesis highlights deficiencies in the Slovenian criminal law regulation regarding the protection against infectious diseases.
