Abstract
Postopek izdaje gradbenega dovoljenja je postopkovno in vsebinsko najzahtevnejši upravni postopek s prepletanjem številne raznovrstne zakonodaje različnih strokovnih panog, ki od uradnika zahtevajo specifična znanja tako gradbene, arhitekturne, prostorske, okoljske, naravovarstvene in kulturnovarstvene stroke. Gre za upravno področje, kjer trčita javni in zasebni interes, država pa s posebnim upravnim postopkom gradbenega dovoljenja balansira razmerje med njima. Tako se v očeh javnosti zdi, da ti postopki trajajo neprimerno dolgo in da so nekatera procesna določila ZUP neprimerno urejena ter potrebne sistemske spremembe. Magistrsko delo se osredotoča na analizo odločanja pritožb pri izdaji gradbenih dovoljenj v Sloveniji. Problematika magistrskega dela se nanaša na iskanje odgovorov na raziskovalna vprašanja glede časovnega okvira reševanja pritožb na MOP, spoštovanja 251. člena ZUP na MOP, primerjalni vidik normativne ureditve instituta odločanja v primerjavi s Hrvaško in institut vložitve tožbe zoper molk organa druge stopnje. Pri raziskovanju so bile uporabljene normativna, primerjalna, zgodovinska, statistična, deskriptivna, dogmatska, primerjalno-pravna metoda, metodi indukcije in dedukcije ter metoda nestrukturiranega intervjuja. S pomočjo uporabljenih metod sem prišla do ugotovitev, da sta Slovenija in Hrvaška na normativnem področju ureditve gradbenega dovoljenja ter drugostopenjskega odločanja v precej podobnem položaju, imata nekaj odstopanj. Problematika zamude pri reševanju pritožbenih zahtevkov na MOP (zdaj na MNVP) in pri drugih obravnavanih organih dejansko obstaja, vendar pa težava ni enoznačna, ampak je odvisna od posameznega resornega področja. Ugotovljeno je bilo, da sistemske spremembe 251. člena ZUP v luči zavezujočega meritornega odločanja ne bi skrajšale postopka upravnega odločanja pri izdaji gradbenega dovoljenja, saj so primerno urejene.

Title:Analysis of the second instance administrative procedure in the field of building permits
Abstract:
The building permit procedure is the most procedurally and substantively complex administrative procedure, involving a wide variety of legislation from different disciplines, requiring specific knowledge of the construction, architectural, planning, environmental, nature conservation and cultural protection disciplines. This is an administrative area where public and private interests collide, and the State balances the relationship between them through the special administrative procedure of the building permit. Thus, in the public eye, it appears that these procedures take an inappropriately long time and that some of the procedural provisions of the ZUP are inadequately regulated and in need of systemic change. The master thesis focuses on the analysis of the adjudication of appeals in the issuance of building permits in Slovenia. The problems of the master's thesis are related to the search for answers to the research questions concerning the timeframe for the resolution of appeals at the MOP, the compliance with Article 251 of the ZUP at the MOP, the comparative aspect of the normative regulation of the institute of decision-making in comparison with Croatia, and the institute of filing a lawsuit against the silence of the second instance authority. The research used normative, comparative, historical, statistical, descriptive, dogmatic, comparative-legal, induction and deduction methods, as well as the method of unstructured interview. The methods used led me to the conclusion that Slovenia and Croatia are in a quite similar situation in the normative field of building permit regulation and second instance decision-making, with some differences. The problem of delays in the resolution of appeals to the MoPD (now the MNVP) and to the other authorities concerned does exist, but the problem is not homogeneous, but depends on the particular sectoral area. It was found that systemic changes to Article 251 of the ZUP in the light of binding meritorious decision-making would not shorten the administrative decision-making process in the issuance of a building permit, as they are adequately regulated.
