The master's thesis deals with legal protection in public procurement procedures. As the name suggests, this is part of the field of public procurement, i.e. the acquisition of goods, services or works by public authorities.
Since public procurement is carried out in the public sector and financed with taxpayers' money, it must be carried out in a transparent and efficient manner, so that it is accessible on equal terms to all interested economic operators. This process is therefore also controlled by a system of legal redress in public procurement procedures, which economic operators can avail themselves of. This ensures that the rules and principles of public procurement are respected. The main role in this system is played by the State Audit Commission for the Review of Public Procurement Procedures (DKOM), which decides on the basis of the Law on Legal Protection in Public Procurement Procedures. For this reason, I have focused my work on the procedures in which it decides and assessed their appropriateness, as well as on its decisions and the impact of its practice on the field itself.
The introductory paragraphs describe the main concepts and outline the development of the field of legal protection in public procurement procedures in Slovenia. I then describe the legal principles of the field and their relevance for the decision-making of the DKOM, followed by an overview of the procedures of legal protection before the DKOM, where I present its (mainly recent) practice, both in terms of procedural and substantive law.
