Abstract
Namen dela je prikazati vpliv (ne)pristranskosti v kazenskem pravu kot ene od tem, s katerimi se pravna teorija, vsaj po avtorjevem mnenju, ukvarja premalo. Naloga je vsebinsko razdeljena v sklope z namenom prikazati (ne)pristranskost sodnega odločanja skozi njegov zgodovinski razvoj, prikazati filozofsko plat (ne)pristranskosti v kazenskem pravu in tudi v pravu nasploh ter zaključiti s prikazom (ne)pristranskosti, kakor se ta odraža v materialnem in procesnem kazenskem pravu. V nalogi sta obravnavani vprašanje dejanske nepristranskosti, ki se pojavlja kot skoraj nedosegljiv ideal, ter vprašanje procesne nepristranskosti, ki, vsaj po mišljenju Evropskega sodišča za človekove pravice, predstavlja srž pojma nepristranskosti v pravu.

Title:The impact of partiality on decision-making in criminal law
Abstract:
The purpose of this paper is to show the impact of (im)partiality in criminal law, as one of the areas to which legal theory, at least in the author's opinion, does not pay enough attention. The paper is divided into sections, in order to show the (im)partiality of judicial decision-making through its historical development, to show the philosophical side of (im)partiality in criminal law as well as in law in general, and to conclude by showing (im)partiality as it is reflected in substantive and procedural criminal law. In this paper, we deal with the issue of de facto impartiality, which emerges as an almost unattainable ideal, and procedural impartiality, which, at least in the opinion of the European Court of Human Rights, is at the heart of the notion of impartiality in law.
