Abstract
Oblikovanje neodvisne Republike Slovenije zaznamuje administrativni izbris 25.671 državljanov drugih republik nekdanje Jugoslavije, ki so imeli v Sloveniji status stalnih prebivalcev. Slovenska osamosvojitvena oblast za državljane drugih republik ni predvidela možnosti ohranitve stalnega prebivališča za osebe, ki so želele ohraniti svoje prvotno državljanstvo. Za te osebe je bila edina možnost za ohranitev pravice do bivanja oddaja prošnje za slovensko državljanstvo v danem roku. Tistemu, ki v ni roku zaprosil za državljanstvo ali pa mu je bila prošnja zavrnjena, so uradniki po sicer nezakonitem postopku stalni naslov izbrisali, s tem pa je izgubil pravico do bivanja v Sloveniji. Na ta način je slovensko državljanstvo dobilo funkcijo izključevanja na temelju narodnosti in politične lojalnosti. Izbris prav tako ni imel zakonske podlage, suvereno upravljanje ministrstva pa je bilo izvedeno na temelju pravne praznine takratnega Zakona o tujcih prek podzakonskih aktov, kot so depeše ministrstva. Te so vsebovale navodila o urejanju evidenc, uničenju dokumentov in navodilo policistom o izgonu oseb brez legalnega statusa. Z izbrisom iz registra stalnih prebivalcev RS so osebe izgubile pravico do bivanja in so bile potisnjene v stanje brezpravnosti. Izbris kot dejanje izobčenja predstavlja dejanje konstitucije nacionalne suverene oblasti in politične skupnosti, katere pravna in simbolna meja je bila določena z izbrisom. Nacionalistično motivirano administrativno čiščenje je namreč v izbrisanih postavilo notranjo mejo in projekcijo zunanjosti prek dejanja izključitve na temelju nacionalne pripadnosti in politične zvestobe. Izbris kot dejanje suverene oblasti je znotraj družbe uveljavil absolutno razliko, ko jih je osamosvojitvena oblast konstruirala v sovražnika. Takšna sovražna določitev je pogoj vzpostavitve suverene oblasti, ki pri izvedbi izbrisa ni vzela v obzir ne zakonskih omejitev ne življenjskih okoliščin prizadetih oseb. Med izbrisanim je bilo namreč tudi 5.360 mladoletnih. Suvereno administrativno upravljanje na temelju nacionalistične demografske politike v obliki izgube pravic in izgona pa je tako prizadelo osebe ne glede na njihovo starost, družinska razmerja ali vojne razmere državah.

Title:Erasure as Constitution of National Sovereignty
Abstract:
The formation of the independent Republic of Slovenia is marked by the administrative erasure of 25,671 citizens of other republics of the former Yugoslavia who had the status of permanent residents in Slovenia. These persons did not apply for Slovenian citizenship within the given deadline or their application was rejected, as the possibility of maintaining their original citizenship and permanent residence was not considered. In this way, Slovenian citizenship was given the function of exclusion from political community based on nationality and political loyalty. The erasure had no legal basis, and the sovereign management of the ministry was carried out because of the legal gap in the Aliens Act through by-laws such as official dispatches from the ministry. These included instructions on editing residency records, destroying identity documents, and instructing police officers to expel persons without legal status. With the erasure of the permanent address, the erased lost their right of residence and fell into a situation of statelessness. Erasure as an act of excommunication represents the constitution of a national sovereign authority and a political community, the boundary of which was determined by erasure. Namely, the nationalist-motivated administrative erasure set an internal boundary of the community and a projection of the exterior in the erased through the act of exclusion. Erasure as an act of sovereign authority established an absolute difference within society that did not take into account the circumstances of the persons affected, as there were 5,360 minors among the erased. Sovereign administrative governance based on nationalist demographic policies in the form of loss of rights and expulsion has thus affected persons regardless of their age, family situation or situation in their war-torn countries.
