Abstract
Zasebnost in varstvo osebnih podatkov sta ključna koncepta dobrega upravljanja, v zvezi s katerima v teoriji in praksi prihaja do številnih nejasnosti in stalnega tehtanja z drugimi človekovimi pravicami z namenom zagotavljanja legitimnosti in zakonitosti njunega uveljavljanja. Z raziskovanjem področja varstva zasebnosti in osebnih podatkov v povezavi s transparentnostjo oblasti prek dostopa do informacij javnega značaja sem v delu skušal ugotoviti, kaj je domet enega in drugega področja ter kje so meje med odprtostjo na eni strani in zaščito zasebnosti na drugi. V magistrskem delu sem z analizo strokovne in znanstvene literature v povezavi s pregledom sodne prakse, komplementarnih virov, študije primera in izbranih ekspertnih intervjujev preučil izzive zasebnosti, varstva osebnih podatkov, transparentnosti in kolizije med njimi ter oblikoval vodila za njihovo obravnavo. Prispevek dela k znanosti je izkazan z uporabo različnih metod raziskovanja, s katerimi sem obravnavano problematiko predstavil z različnih zornih kotov. Obravnavano področje po vsebini in pripadajočih metodah nedvomno sodi na področje upravno-pravne znanosti, vendar se glede na obravnavano tematiko dotika tudi področij upravnega sistema, informacijskih ved, sociološko-politoloških znanosti, delno tudi organizacije in managementa v upravi ter tako z multidisciplinarnim pristopom prispeva k analizi obravnavane teme. V delu sklepno ugotavljam, da pravici zasebnosti in varstva osebnih podatkov nista niti absolutni niti samoumevni, temveč ju je treba stalno tehtati, se za njiju boriti in ju s strani oblasti skrbno varovati ter vzpostavljati pogoje za njuno učinkovito uveljavitev, kar se kaže ključnega pomena zlasti v času hitrega tehnološkega napredka in razmer, povezanih z epidemijo. Nedvomno evropski pravni prostor napram drugim (na primer Kitajski) predstavlja zlati standard zagotavljanja obeh pravic in njunega sorazmernega uravnoteženja, kar je zaradi pomembnosti in krhkosti pravic ključnega pomena. Pomembno se mi zdi, da se tako oblast kot posamezniki v popolnosti zavedajo obeh pravic, njunih mej, dometa in mehanizmov uveljavitve, kjer pa glede na raziskano vidim še kar nekaj prostora za izboljšavo.

Title:Freedom in a surveillance state? The concept of privacy and personal data protection in conflict with the authority and under its protection
Abstract:
Privacy and the protection of personal data are two key concepts of good governance that are subject to several ambiguities in theory and practice, as well as constant balancing with other human rights to ensure the legitimacy and legality of their exercise. By researching the fields of protection of privacy and personal data in connection with the transparency of government through access to public information, I tried to determine the scope of the two fields and the boundaries between transparency on one hand and privacy on the other. In my master's thesis, I analysed the challenges of privacy, personal data protection, transparency and collisions between them. I also analysed the guidelines for dealing therewith by analysing the professional and scientific literature and reviewing case law, complementary sources, case studies, and selected expert interviews. The thesis’ contribution to science is demonstrated by using different research methods to present the above issues from different angles. Given their content and related procedures, they undoubtedly belong to the field of administrative law while also concerning the administrative system, information sciences, socio-political sciences, partly organization and management in administration. Such multidisciplinary approach importantly contributes to the analysis of the topic under consideration. I conclude that the rights to privacy and personal data protection are neither absolute nor self-evident but must be constantly balanced, fought for, and carefully protected by the authorities while creating conditions for their effective enforcement, which has proven crucial especially at a time of rapid technological advances and during the pandemic. Undoubtedly, the European legal space, compared to others (for example, China), represents the gold standard of guaranteeing both rights and their proportional balance, which is crucial due to their importance and fragility. I find it important that both the authorities and individuals are fully aware of the two rights and their limits, scope, and enforcement mechanisms. Based on my research, I see in that area considerable room for improvement.
