Institut vzajemno neizpolnjene dvostranske pogode v stečajnem postopku omogoča stečajnemu dolžniku, da pogodbo, ki je nobena izmed strank ni izpolnila v celoti, izpolni po pravilih o plačilu stroškov stečajnega postopka, ali od pogodbe odstopi. To lahko stori z odstopno izjavo, h kateri mora sodišče podati soglasje.

Abstract

In the case of mutually unperformed billateral contracts in bancruptcy proceedings, when neither of the parties have carried out their whole obligation according to the contract, the debtor can either carry out the contract as an expense of the bancruptcy proceedings or terminate such a contract with a statement, which must be approved by the court.
