Abstract
Magistrsko diplomsko delo obravnava vprašanje omejevanja lastninske pravice z vidika prisilnih prodaj. V uvodnem delu sta opredeljena pojem in predmet lastninske pravice, s poudarkom na nepremičninah, strnjeno so opisane glavne značilnosti lastninske pravice in postopka pridobivanja lastninske pravice v dveh najpogostejših postopkih sodnih prodaj v Republiki Sloveniji. Sledi predstavitev pojma omejevanje lastninske pravice, kratek zgodovinski pregled in predstavitev splošne pozitivnopravne ureditve. Osrednji del je namenjen (kar se da strnjeni in sistematični) predstavitvi različnih načinov omejevanja lastninske pravice, ki se pojavljajo v specialni zakonodaji, aktualnih vprašanj in problematik, ki vplivajo na postopek prodaje nepremičnine v izvršilnem in stečajnem postopku. Razlaga pravil je ponazorjena s primeri iz slovenske sodne prakse.

Title:Limits on the Right to Property in Public Interest in Terms of Forced Sale
Abstract:
The Master's thesis examines the issue of restricting property rights in public interest from the point of view of forced sales. The introductory part defines the concept and subject of property right, with an emphasis on real estate, and summarizes the main characteristics of property rights and the procedure for acquiring property rights in the two most common court sales procedures in the Republic of Slovenia. This is followed by a presentation of the concept of »restriction of the property right«, a brief historical overview, and a presentation of the positive legal rules in general. The central part is intended (as concise and systematic as possible) to present the various ways of restricting property rights that arise in field-specific legislation, current issues, and issues affecting the sale of real estate in enforcement and bankruptcy proceedings. The rules are illustrated by national case law.
