Abstract
Magistrsko delo obravnava nasilje na delovnem mestu s strani tretjih oseb s pravnega vidika, z osredotočenostjo na notranjo pravno ureditev nasilja na delovnem mestu s strani tretjih oseb na visokošolskih institucijah. Problem je v dosedanjih raziskavah slabše raziskan. S pravno analizo so prikazane splošne značilnosti mednarodne in slovenske pravne ureditve nasilja na delovnem mestu s strani tretjih oseb. Mednarodna pravna ureditev v večini splošno in smiselno ureja nasilje tretjih oseb, z več specialnimi določbami v novejših mednarodnih pravnih aktih, medtem ko problem nasilja tretjih oseb v slovenski pravni ureditvi ni celostno zastopan, kar vpliva tudi na notranjo pravno ureditev. Raziskava pravne ureditve nasilja na delovnem mestu s strani tretjih oseb je bila izvedena na vzorcu javnih družboslovnih visokošolskih institucij v Sloveniji. Ugotovitve izvedene raziskave kažejo, da so delavci na visokošolskih institucijah največkrat deležni verbalnega in psihičnega nasilja. Izbrane visokošolske institucije se opirajo na smiselno rabo splošnih določb v skupnih univerzitetnih pravilnikih o nadlegovanju in trpinčenju, zato posebna pravna ureditev nasilja tretjih oseb izostaja. Rezultati raziskave so prvi korak k razumevanju problematike nasilja tretjih oseb, saj je vzorec v raziskavi omejen le na javne družboslovne visokošolske institucije v Sloveniji, zato rezultatov raziskave ni mogoče posplošiti na celoten visokošolski prostor. Prispevek magistrskega dela je v dvigu splošne ozaveščenosti in razumevanju problema nasilja tretjih oseb in v predlogih rešitev visokošolskim institucijam na področju ureditve nasilja tretjih oseb

Title:THIRD PARTY VIOLENCE IN THE WORKPLACE IN HIGHER EDUCATION INSTITUTIONS
Abstract:
Master’s thesis discusses third party violence in the workplace from legal aspect with focus on internal legal regulation of third party violence in higher education institutions. General characteristics of international and Slovenian legal regulation of third party violence at workplace are provided in the scope of conducted legal analysis. International legal regulation for the most part includes general and therefore reasonably applicable provisions for cases of third party violence with higher level of particular provisions for third party violence regulation in newer international legal acts; meanwhile the problem of third party violence in Slovenian legal regulation is not globally represented, which also affects the internal legal regulation. Research of legal regulation of third party violence at workplace was conducted on a sample of public social science institutions in Slovenia. Findings of conducted research show that workers in higher education institutions are most times subjected to verbal and psychical violence. Selected higher education institutions rely on common sense use of general provisions in common university regulations related to harassment and maltreatment, which is why separate legal regulation of third party violence is falling behind. Results of the research present the first step to understanding the problematics of third party violence in workplace, since the sample of the research is limited only to public social science institutions in Slovenia, which is why results of the research cannot be generalized to the overall higher education area. With this master’s thesis we can contribute to raising general awareness and understating of third party violence and propose solutions to higher education institutions in the field of third party violence regulation.
