Abstract
Pravni sistem v ZDA omogoča učinkovito reševanje sporov preko relativno enostavnih, hitrih in obenem ekonomsko učinkovitih postopkov. To nam v praksi potrdijo sodišča za spore majhne vrednosti, saj glede na ekonomsko analizo zagotavljajo nizke stroške poslovanja in minimalno finančno breme za stranke. Poleg tega je cilj teh sodišč tudi omogočiti dostop do sodstva čim širšemu krogu ljudi. Za zagotavljanje izpolnjevanja zastavljenih ciljev pa imajo države ZDA različne prioritete in temu sledijo tudi različne višine najvišjih možnih denarnih limitov oziroma zneskov, ki določajo pojem spora majhne vrednosti. Sodišča za spore majhne vrednosti so bistveni sestavni del večplastne strategije za spodbujanje dostopa do pravnega varstva, prav zato pa je pomembna tudi njihova učinkovitost, saj bo le tako ugled pravnega postopka v očeh javnosti ohranjen. Možnosti za izboljšave in povečanje ekonomske učinkovitosti sporov majhne vrednosti so še velike, zato se zagotovo obeta zanimiva prihodnost s pomembnimi digitalnimi rešitvami, ki so že na pragu realizacije v sodobnih pravnih sistemih.

Title:Regulation of Small Claims in the US - economic analysis
Abstract:
The legal system in the U.S. enables effective resolution of disputes through relatively simple, fast and at the same time cost-effective procedures. This is confirmed in practice by Small Claims Courts, as, according to the economic analysis, they ensure low operating costs and minimal financial burdens for clients. In addition, the aim of these courts is to provide access to justice to a circle of people as wide as possible. In order to ensure the fulfillment of the set goals, the U.S. countries have different priorities and this is followed by different amounts of the highest possible monetary limits or amounts that determine the concept of Small Claims. The Small Claims Courts are an essential component of a multifaceted strategy to promote access to justice, which is why its effectiveness is important, as it will only preserve the reputation of legal proceedings in the eyes of the public and ensure that the right to justice is met. The possibilities for improving and increasing the economic efficiency of small claims are still wide open, so an interesting future is certainly under way with important digital solutions that are already on the verge of realization in the modern legal system.
