Abstract
Zaščitene kmetije so kmetije oziroma kmetijsko-gozdarske gospodarske enote, ki so v lasti ene fizične osebe, solastništvu ali skupni lasti zakoncev, starša in otroka ali posvojenca oziroma njegovega potomca. Zaščitena kmetija zajema kmetijska zemljišča, gozdove in stanovanjska poslopja skupaj z zemljišči, ki so potrebna ali namenjena za redno uporabo stavbe, kmetijske priprave, orodja in živine. Med tovrstne kmetije lahko spadajo le tiste, ki imajo od pet do sto hektarov primerljive kmetijske površine. Status zaščitene kmetije podeli upravna enota po uradni dolžnosti. V tej diplomski nalogi bomo pregledali in primerjali aktualno in preteklo slovensko zakonodajo ter zakonodajo izbranih držav EU, ki ureja zaščito kmetij pred drobitvijo njihove posesti. Opisali bomo razlike med posameznimi pristopi ter morebitne ukrepe, ki bi še dodatno okrepili gospodarsko moč kmetij ter obenem omogočili tudi ekonomsko in socialno stabilnost dedičev. Tekom izdelave diplomske naloge smo spoznali, da se starejši lastniki zaščitenih kmetij strinjajo z zakonom, zdi se jim dober, medtem ko mlajšim pogosto predstavlja oviro, saj gre za omejitev pri prostem razpolaganju z zemljišči. Čeprav so lastniki kmetije, ne morejo prodajati delov zemlje, kot bi želeli.

Title:Overview of the regulation on the protection of farms against the fragmentation of their property
Abstract:
Protected farms are farms or agro- m-economic units owned by one natural person, co-owned or jointly owned by a married couple, or a parent and child or adopted child, or their descendants. A protected farm encompasses forestry and residential buildings, along with land necessary intended for regular usage by a building, agricultural device tool or livestock. Only farms comprising of a least five hectares and not more than hundred hectares of comparable agricultural land qualify as protected farms. The status for protected farm can be granted by administrative unit of its own motion. In this bachelor thesis we will examine and compare current and past Slovenian legislation and the legislation of selected EU Member States, which covers the protection of farms against the fragmentation of their property. The differences between individual approaches and possible measures, that could further strengthen the economic power of farms and at the same time also enable economic and social stability of heirs, will be described. While writing this degree, we recognised that the older owners concur with the law and think well of it, whereas the younger owns view it as an obstacle, since this limits their free disposal of the land. Although they are the owners of farms, they cannot sell parts of the land as desired.
