Abstract
Spolno nadlegovanje je še vedno tema, ki ni kritično obravnavana, posebej skrb vzbujajoče pa je dejstvo, da se lahko z njim zaposleni srečujejo na delovnem mestu, kjer preživijo del oziroma precejšen del svojega delovnega dne. Delodajalec je dolžan poskrbeti, da se zaposleni na delovnem mestu počutijo varno in zdravo ter da jim niso kršene pravice osebnega dostojanstva, zasebnosti in varnosti. Na delovnem mestu se lahko pojavi več oblik spolnega nadlegovanja, med njimi so verbalno, neverbalno in fizično nadlegovanje. Pogosto se žrtve nadlegovanja ne odločijo za tožbo proti svojemu nadlegovalcu, saj se ob tem počutijo osramočeno in nelagodno. Posledice spolnega nadlegovanja nosijo tako žrtve spolnega nadlegovanja kot delovno okolje, kjer se je le-to zgodilo. Tako kot zakon ščiti žrtve – zaposlene, po drugi strani določa delodajalcem, kako ukrepati v primeru spolnega nadlegovanja na delovnem mestu oziroma preprečiti leto. V diplomskem delu predstavimo analizo izbranih sodnih odločb in analizo pravnih virov. Ugotovili smo, da vsako leto le majhno število primerov glede spolnega nadlegovanja pride na sodišča v Sloveniji. Opisali smo več različnih opredelitev spolnega nadlegovanja, čeprav so si med seboj rahlo različne, imajo več skupnih točk. Evropska unija zadnje čase posveča vedno več pozornosti spolnemu nadlegovanju, glede na to, da je Slovenija članica EU, pa to pomeni, da naši politiki prav tako sodelujejo v tej tematiki. V Sloveniji imamo različne zakone, ki varujejo človekove osebne pravice in pravice varnosti, prav tako določajo, kako ukrepati v primeru kršenja le-teh oziroma v primeru spolnega nadlegovanja. V ozaveščanje o znakih spolnega nadlegovanja na delovnem mestu in posledicah le-tega bi bilo treba vlagati veliko več truda in časa, tako bi zaposleni hitreje prepoznali nadlegovanje in ukrepali, glede na to, da s pomočjo večjega ozaveščanja spolno nadlegovanje ne bi bila zapostavljena tema, ki ni kritično obravnavana.

Title:LEGAL ASPECTS OF PREVENTING AND TAKING ACTIONS ON SEXUAL HARASSMENT IN THE WORKPLACE
Abstract:
Sexual harassment is still a topic that has not been critically considered, and it is particularly worrying that employees are still experiencing in the workplace, where they spend part or even large part of their working day. The employer is responsible to ensure that employees feel safe and healthy in the workplace and their rights to personal dignity, privacy and security are not violated. There are several forms of sexual harassment that can occur at work, including verbal, non-verbal, and physical. Often, victims of harassment do not choose to sue their harasser because they feel ashamed and uncomfortable. The consequences of sexual harassment impact both victims of the sexual harassment and the work environment where it occurred. Just as the law protects the victims, i.e. the employees, it also defines how the employers have to act in case of sexual harassment in the workplace i.e. how to prevent it. The graduation thesis presents the analysis of selected court decisions and the analysis of legal sources. It has been found that every year a small number of cases of sexual harassment comes to the courts of Slovenia. Several different definitions of sexual harassment have been given here, and although they slightly differ from each other, they have a lot in common. The European Union has been increasingly paying attention to sexual harassment, and since Slovenia is an EU member state it means that our politicians are also participating in this issue. Slovenia has various laws that protect human rights and security, which determine how to act in case of their violation or in case of sexual harassment. To raise the awareness of the signs of sexual harassment in the workplace and its consequences it would require much more effort and time, so that employees could more quickly identify harassment and take appropriate action, and accordingly, with greater awareness, sexual harassment would not be a neglected topic that has not been critically considered.
