Abstract
Multilateralno ali večstransko pobotanje je posebna vrsta pobotanja, ki temelji na splošnih obligacijskopravnih pravilih in predstavlja prenehanje treh ali več medsebojnih terjatev med tremi ali več strankami. Namen in ekonomski cilj večstranskega pobotanja je prenehanje medsebojnih denarnih obveznosti več udeležencev, ne da bi bilo plačilo izvedeno v denarju. Magistrsko diplomsko delo obravnava institut večstranskega pobotanja v slovenski pravni ureditvi. Uvodu sledi drugo poglavje s predstavitvijo materialnopravnega pobotanja, kot ga urejajo obligacijskopravna pravila, in opis drugih vrst pobotanja. V tretjem poglavju je predstavljen institut večstranskega pobotanja v razmerju z materialnopravnim pobotanjem in njegova vsebina, kot jo je izoblikovala sodna praksa še pred sprejetjem Zakona o preprečevanju zamud pri plačilih. V četrtem poglavju sledi opis problema plačilne nediscipline in vsebina relevantne evropske in slovenske zakonodaje. V petem in šestem poglavju sta podrobneje opisana prostovoljni in obvezni večstranski pobot, kot ju ureja današnja zakonodaja. Sedmo poglavje je namenjeno predstavitvi nekaterih glavnih problemov, ki so se glede večstranskega pobotanja pojavili po sprejetju Zakona o preprečevanju zamud pri plačilih. V osmem poglavju sledijo moje ugotovitve in zaključki glede vprašanja, ali je institut večstranskega pobotanja učinkovito orodje za dosego cilja, zaradi katerega je bil ustanovljen, ter ali je v času od uveljavitve tudi dejansko prispeval k zmanjšanju plačilne nediscipline.

Title:Multilateral compensation
Abstract:
Multilateral compensation is a special type of compensation based on the law of obligations, which appears in termination of three or more mutual obligations between three or more parties. The purpose and economic objective of the mentioned legal institute is to terminate mutual monetary obligations between three or more parties without making the payment in cash. This master thesis deals with the institute of multilateral compensation as regulated in Slovenian legal system. The introduction is followed by the second chapter which describes the basics of the law of obligations' institute of compensation and a description of other types of compensation. The third chapter presents the institute of multilateral compensation in relation to bilateral compensation, followed by the description of its content, as defined by the Slovenian case law, before the adoption of the Slovenian Act on prevention of late payments. Chapter four describes the issue with late payments and relevant European and Slovenian legislation. Chapter five and six provide a more detailed description of voluntary and mandatory multilateral compensation as governed today by Slovenian law. The seventh chapter is intended to outline some of the key issues regarding multilateral compensation raised after adoption of the Slovenian Act on prevention of late payments. And chapter eight is presenting my conclusions and findings on the question of whether the multilateral compensation is an effective tool to achieve the purpose for which it was established, and whether it has actually contributed to decrease of late payments in Slovenia.
