The central theme of the master's thesis is changes in the fields of custody and parenting time of children, both through the practice of the courts and in the normative field. Before I started writing my master's thesis, when reviewing the case law, I noticed that the court's decisions on the same issues changed over time, but on certain issues the case law was not uniform, as a concrete realization of these changes and a positive acquisition in the Slovenian legislation in terms of legal certainty it meant the adoption of the Family Code (Official Journal RS, no. 15/17, 21/18, 22/19 - hereinafter: National Assembly). Prior to adoption, our legislation in the family field was quite rigid and only slowly adapted to the needs of modern life, while parallel to legislation quite a number of mental leaps were made in the field of judicial practice to ensure the best interests of the child. In addition to the novelties introduced by the National Assembly in the field of decision-making on custody and parenting time, the master's thesis will present, in parallel with each chapter, a comprehensive analysis of the case law, through which many changes will be brought to light, despite the fact that the Law on Marriage and Family Relations (Official Journal RS, no. 69/04, 101/07, 84/12, 82/15, 15/17, 30/18 - hereinafter: Marriage and Family Relations Act) did not change much, however, these changes occurred behind closed doors of courtrooms, which undoubtedly greatly contributed to the overall reform of family law.
