Abstract
Z obdobjem digitalizacije so se začele pojavljati tudi nove oblike dela. V tujini in tudi pri nas so vse bolj zanimiva predvsem dela prek tako imenovanih spletnih platform, ko praviloma ustvarjalec spletne platforme poveže naročnika dela in izvajalca dela. Pri tovrstnih oblikah dela naj bi šlo bolj za priložnostno oziroma popoldansko delo, s katerim si lahko posameznik izboljša finančni položaj, a raziskave kažejo, da takšna oblika dela zavzema vse večji delež v delovnopravnih razmerjih, kar pomeni, da je vse več osebam tovrstna oblika dela primarni oziroma edini vir dohodka. Takšen delavec si ne more privoščiti, da bi delo odklonil, hkrati pa ni deležen ustrezne socialne varnosti in socialnih zavarovanj, saj so po sedanji zakonodaji večine socialnih zavarovanj deležni le delavci, ki so zaposleni v eni izmed formalnih oblik dela (delovno razmerje, civilne pogodbe). V diplomskem delu je predstavljeno delo na zahtevo kot ena izmed najbolj rastočih atipičnih oblik dela. Z metodo analize sekundarnih podatkov so predstavljene tudi pomanjkljivosti v zakonih, ki urejajo socialna zavarovanja v Republiki Sloveniji, v povezavi z delom na zahtevo. Delavci, ki opravljajo delo na zahtevo, niso deležni zadovoljive socialne varnosti ne v Sloveniji ne v Evropski uniji. Čeprav se tako Evropska unija kot tudi države članice zavedajo težave nezadostne socialne varnosti delavcev, ki opravljajo delo na zahtevo, pa zadeva še zdaleč ni primerno zakonsko urejena. Ključne težave so še vedno glede klasifikacije dela na zahtevo in glede primerne umestitve dela na zahtevo v obstoječe zakone, ki urejajo socialna zavarovanja.

Title:SOCIAL SECURITY IN PERFORMING WORK ON DEMAND
Abstract:
The era of digitalisation has introduced new forms of works. Abroad as well as in Slovenia, working through a so-called online platform, where the creator of the platform connects contracting authorities and contractors, is gaining more and more interest. This type of work was supposed to encompass mainly casual or afternoon jobs, undertaken by individuals in order to improve their financial situation. Nonetheless, according to research, this type of work represents an increasing proportion of employment relationships, meaning that for a growing number of people performing this type of work means a primary (or the only) source of income. Such a worker cannot allow themselves to refuse a job and, at the same time, cannot profit from corresponding social security and social insurance – the current legislation mostly allows social security to workers employed in one of the formal types of work (employment relationship, civil contract). This paper presents work on demand as one of the fastest growing atypical forms of work and, using a secondary data analysis method, portrays the shortcomings in laws regulating social insurance in relation to work on demand in the Republic of Slovenia. Workers performing work on demand do not receive satisfactory social security in Slovenia nor in the European Union. Even though the EU and its member states are aware how problematic obtaining social security can be for workers performing work on demand, there are no laws appropriately regulating the matter. One of the key problems lays in the classification of work on demand and a suitable placement of work on demand in existing laws regulating social insurance.
