Abstract
V slovenski zakonodaji je promet po notranjih plovnih poteh reguliran z različnimi predpisi. Država in občine imajo tako določene pristojnosti pri urejanju plovbe po celinskih vodah, kjer pa se pojavljajo problemi. To področje bi bilo nujno obravnavati celovito, v praksi pa ga vsako zase obravnavata Ministrstvo za infrastrukturo, ki je pristojno za Zakon o plovbi po celinskih vodah, ter Ministrstvo za okolje in prostor, ki je pristojno za Zakon o vodah, medtem ko lokalne skupnosti po svoje določajo plovbne režime z občinskimi odloki. Problematika se kaže tudi pri nadzoru nad izvajanjem zakonodaje in lokalnih predpisov. Kot osnovno izhodišče so v magistrskem delu raziskana zgodovinska dejstva o nekdaj pomembnih plovbnih območjih slovenskih rek. Sledita izvedeni normativni študiji ključnih predpisov o plovbi po celinskih vodah v Evropski uniji (EU) in v Republiki Sloveniji (RS), nato pa študija primera Mednarodne komisije za Savski bazen ter raziskava o potencialnih vplivih obremenitev, ki jih povzroča plovba s plovili na motorni pogon. Magistrsko delo vsebuje tudi analizo posebnosti nadzora nad plovbo po celinskih vodah in problematike pristojnosti nadzornih organov. Rezultati raziskave so potrdili hipotezo, da bi z ustrezno ureditvijo področja plovbe po celinskih vodah lahko razbremenili cestni transport in s tem pomembno prispevali k zmanjševanju onesnaževanja okolja zaradi prometa. Študija primera Savske komisije je pokazala, da RS kot članica Mednarodne komisije za Savski bazen ne prepozna obstoječega razvojnega potenciala za razvoj plovbe. Potrjena je bila tudi hipoteza, ki se nanaša na nadzor plovbe po celinskih vodah v RS, ki je pomanjkljiv in neustrezno urejen. Na podlagi ugotovljenega stanja so v RS potrebne korenite spremembe na tem področju.

Title:PROBLEMS OF THE STATE AND MUNICIPALITIES’ COMPETENCE IN NAVIGATING INLAND WATERWAYS
Abstract:
Slovenian legislation regulates inland waterway transport by various regulations. The state and municipalities thus have certain responsibilities in regulating inland navigation, where problems arise. This area would urgently need to be dealt comprehensively, and in practice it is addressed individually by the Ministry of Infrastructure responsible for the Inland Waterways Navigation Act and the Ministry of the Environment and Spatial Planning responsible for the Water Act, each while local communities, in their own right, determine navigational regimes with municipal ordinances. There is also a problem in monitoring the implementation of legislation and local regulations. As a basic starting point, the master's thesis explores historical facts of the once important navigable areas of Slovenian rivers. This is followed by a normative study of key regulations on inland navigation in the European Union (EU) and the Republic of Slovenia (RS), followed by a case study of the International Sava River Basin Commission and a study of the potential effects of loads caused by motorized vessel navigation. The master's thesis also contains an analysis of the peculiarities of the control of inland navigation and the problems of the powers of the supervisory authorities. The results of the study confirmed the hypothesis that, by properly regulating the inland navigation area, road transport could be relieved and thus significantly contribute to the reduction of environmental pollution due to transport. The case study of the ISRBC showed that, as a member of the International Sava River Basin Commission, the Republic of Slovenia does not recognize the existing development potential for the development of navigation. The hypothesis concerning the control of inland navigation in the RS, which is deficient and inadequately regulated, was also confirmed. Based on the established situation, radical changes in this area are needed in the Republic of Slovenia.
