Abstract
Država oziroma lokalna samouprava s svojo servisno funkcijo v javnopravnem režimu zagotavlja določene storitve in dobrine, ki zaradi javnega interesa in javne potrebe ne morejo biti prepuščene trgu. Te pa lahko izvajajo domače in tuje fizične ter pravne osebe. Ena izmed teh storitev je zdravstvena dejavnost, ki je glavnega pomena za blaginjo in doprinos ne le vsakega posameznika, temveč tudi celotnega prebivalstva. Zdravstvena dejavnost se lahko izvaja v obliki javnega zavoda ali pa v obliki fizične ali pravne osebe na podlagi koncesije. Namen diplomskega dela je raziskati, kako in na kakšen način se koncesije na področju zdravstva podeljujejo in izvajajo. Teoretični del na metodi deskripcije opisuje pojem javne službe, pojem koncesije ter kako se jo izvaja v zdravstveni dejavnosti. Pojasnjene so prednosti in slabosti koncesionirane javne zdravstvene službe ter položaj koncesionarjev v primerjavi z javnimi zavodi. Na podlagi primerjalne analize so primerjani podatki o stanju koncesionarjev v Sloveniji ter problematika zakonske ureditve pri podeljevanju koncesij. Zastavljeni cilji so v diplomskem delu pokazali zanimive rezultate. Ugotovljeno je bilo, da je število koncesionarjev skozi leta naraščalo, kakor so se povečevali tudi zasebni izdatki v odstotku bruto domačega proizvoda. Tu je dobiček predstavljal enega od glavnih razlogov, ki je vplival na rast koncesionarjev. Drugi zanimiv podatek je, da so se koncesije v preteklosti podeljevale na netransparenten način, brez soglasja ministrstva za zdravje in na voljo stranke, glavna vzroka sta bila neobvezen koncesijski akt in javni razpis.

Title:GRANTING AND CONDUCTING CONCESSIONS IN THE FIELD OF SLOVENIAN HEALTHCARE
Abstract:
The state or the local self-government with its service function in the public legal regime provides certain services and goods that cannot be left to the market due to public interest and public need. These may be carried out by domestic and foreign natural or juridical persons. One of these services is the healthcare system, which is of major importance to the well-being of each individual as well as the entire population. The medical activity may be carried out in the form of a public institution or in the form of a natural or juridical person based on a concession. The purpose of this diploma thesis is to investigate how and in what way are these concessions granted and implemented. The theoretical part with the help of a descriptive method describes the concept of public service, the concept of concession and how it is implemented in the healthcare system. The advantages and disadvantages of the concessionary public health service and the position of the concessionaires in relation to public institutions are also explained. Based on the comparative analysis, the data on the condition of the concessionaires in Slovenia and the problems of legal regulation in granting concessions are compared. Most of the goals in the diploma thesis are achieved where interesting results have been found. It was found that the number of concessionaires increased over the years, as did private expenditures as a percentage of gross domestic product. One of the main reasons that influenced this growth was profit. Another interesting fact is, that in the past, concessions were being awarded in a non-transparent manner, without the consent of the ministry of health and at the disposal of the parties, the main reasons being the optional concession act and public tender.
