Abstract
Iz naslova je razvidno, da Starševstvo po razvezi: sociološka analiza argumentov sodišč pri dodelitvi otrok enemu od staršev posveča sociološki analizi starševskih vlog v postopku razveze oziroma po razvezi. Podatki Vrhovnega sodišča Republike Slovenije razkrivajo, da je bilo v časovnem obdobju 2007–2018 v Sloveniji ob razvezah 75,3 % otrok dodeljenih materam in zgolj 9,7 % očetom. Slednji podatek nakazuje na prisotnost še vedno živeče moderne ideologije o materinstvu in nepoznavanju sociološkega pojava aktivnega očetovanja v sodniških vrstah, kar predstavlja raziskovalni problem pričujočega dela. Temeljna metoda raziskovalnega dela temelji na analizi vsebine odločb o razvezi in dodelitvi otrok določenemu staršu – predstavljene so tudi vloge akterjev, ki vplivajo na končno odločitev slovenskih sodnic in sodnikov pri dodelitvi otrok. Ključna ugotovitev analize primerov dodelitve otrok določenemu staršu kaže sliko neenakopravnega obravnavanja starševskih vlog v postopku razveze, kljub mnogim prizadevanjem s strani očetov za aktivno sodelovanje pri vzgoji in varstvu otrok/a. Rešitev se ponuja v promociji številnih socioloških raziskav na temo aktivnega očetovanja po razvezi; da le-ta doseže tudi slovenske sodnike in sodnice. Slednje, zraven preučitve primerov in problematiziranja zakoreninjenosti predstave o ideologiji materinstva, predstavlja tudi cilj pričujočega dela.

Title:Divorce Parenthood: A Sociological Analysis of Court Arguments in Assigning Children to One Parent in Slovenia
Abstract:
The title shows that Parenthood after a divorce: Sociological analysis of the arguments of the courts in granting a child to one parent devotes to sociological analysis of parental roles in the process of divorce or after divorce. The data of the Supreme Court of the Republic of Slovenia are revealing, that in the period 2007-2018, in Slovenia, were after a divorce 75.3% of children given to mothers and only 9.7% to fathers. The latter information indicates the presence of a still living modern ideology of motherhood and ignorance of the sociological phenomenon of active fatherhood in the judicial ranks, which represents the research problem of the present work. The basic method of research is based on an analysis of the content of decisions after divorce and assigning children to a specific parent - there are also presented roles of different participles, which have an influence on the final decision of Slovenian judges in the allocation of children. A key finding of the analysis of case allocation child to specific parent presents a picture of unequal treatment parental roles in divorce proceedings, despite many efforts by fathers to participate actively in childcare. The solution is offered in the promotion of a number of sociological research with the topic of active fatherhood after divorce; that this one also reaches Slovenian judges. This, next to the examination of cases and the problems of a deeply rooted ideas about the ideology of motherhood, represents also the essence of the present work.
