Abstract
Začetni del magistrskega diplomskega dela, skozi pregled mednarodne, evropske in nacionalne pravne ureditve, ter predstavitev vloge delavca in delodajalca pri zagotavljanju varnega in zdravega dela, osvetli pomembnost delovnega prava v ožjem okviru varnosti in zdravja pri delu. V nadaljevanju dela je podrobneje razčlenjena temeljna dolžnost delodajalca, ki jo določa 17. člen ZVZD-1 in sicer ocenjevanje tveganja in na njegovi podlagi sprejem obveznega internega akta, ki se imenuje izjava o varnosti z oceno tveganja. Izvedena je tudi ocena tveganja na tipičnem delovnem mestu 'pravnik'. Namen ocenjevanja tveganja je prikaz zmotnega mišljenja, ki se večkrat kaže v tem, da se tveganja, ki izvirajo iz opravljanja pravniških in drugih pisarniških del, prevečkrat podcenjujejo, kar lahko posledično vodi v nezgode pri delu ali poklicne bolezni delavcev na tovrstnih delovnih mestih. V nadaljevanju dela je podrobneje predstavljena pravica delavca, da poda izredno odpoved, kadar delodajalec krši obveznosti zagotavljanja varnih delovnih razmer, kar je tudi eden izmed zakonsko določenih razlogov za izredno odpoved pogodbe o zaposlitvi na strani delodajalca. Cilj tega dela je predvsem širjenje zavedanja, da je zdravje podlaga za dobro in uspešno življenje in delo, kar ne velja le za posameznike temveč tudi za podjetja in državo. Zdravi in zadovoljni delavci, ki delajo v varnem in spodbudnem okolju, so vedno produktivnejši, redkeje zbolijo, ostajajo zvesti delodajalcu in s svojim pozitivnim odnosom prispevajo k boljšemu ugledu podjetja v javnosti.

Title:Breach of ensuring health and safety regulations at work as a reason for an extraordinary termination of the employment contract
Abstract:
Firstly, this master thesis highlights the importance of labor law in occupational health and safety framework, while reviewing the international, European and national legal arrangements, and discusses the role of the worker and employer to ensure safe and healthy work. Furthermore, the basic duty of the employer determined by Article 17 of the ZVZD-1 is discussed in detail, focusing on the assessment of the risk and the adoption of a compulsory internal act called risk assessment. Moreover, an assessment of the risk of a job position 'lawyer' is conducted. The purpose of risk assessment is to visualise the misconceptions that show how risks arising from legal and other office work are too often underestimated, which can result in accidents at work or occupational illness of workers in such positions. In addition, the right to give an extraordinary termination is presented in greater detail, enabling the employee to terminate the contract once the employer violates the safety and health at work, as this is also one of the legally defined reasons for the extraordinary termination of the employment contract on the employer's side. The aim of this master thesis is to spread awareness of health, being the basis for a good and successful life and work, not only for individuals, but also for businesses and the country. Healthy and satisfied workers working in a safe and stimulating environment are more productive, rarely get ill, and remain faithful to the employer. With this in mind, employees' positive attitude can contribute to a better company reputation.
