Abstract
Diplomsko delo predstavlja problematiko zaposlovanja tujih državljanov iz držav nekdanje Jugoslavije v Republiki Sloveniji (v nadaljevanju RS). Predstavljena je ureditev področja zaposlovanja tujcev v RS in opis postopkov in pogojev, ki jih mora tujec izpolnjevati, če želi pridobiti enotno dovoljenje za prebivanje in delo v RS. Predstavljen je tudi vpliv direktiv Evropske unije (v nadaljevanju EU) na ureditev področja zaposlovanja tujcev v RS. Problematiko oziroma najpogostejše ovire pri zaposlovanju tujih državljanov v RS sem raziskala predvsem s pomočjo anketnega vprašalnika za delodajalce, ki zaposlujejo tujce. Z analizo Zakona o zaposlovanju, samozaposlovanju in delu tujcev sem opredelila bistvene spremembe, prednosti in slabosti na področju zaposlovanja tujcev. S pomočjo anketnega vprašalnika, primerjalne metode, normativne in deskriptivne metode sem lahko preverila hipoteze, postavljene v uvodu diplomskega dela. Na podlagi primerjalne metode, s katero sem primerjala preteklo in sedanjo zakonodajo, sem raziskovala, ali slovenska pravna ureditev na področju zaposlovanja tujcev v RS sledi direktivam EU. Postopek pridobitve enotnega dovoljenja za prebivanje in delo se je spremenil in se rešuje hitreje kot pred sprejetjem nove zakonodaje leta 2015, še vedno pa obstajajo določene administrativne ovire, ki postopek lahko podaljšajo za mesec dni ali več. Veliko je tudi nejasnosti glede prilog k vlogi za izdajo enotnega dovoljenja, birokratskih ovir in neusklajenosti med upravnimi enotami. Z diplomskim delom sem prikazala, da je problematika zaposlovanja tujcev še vedno prisotna v slovenskem prostoru, čeprav se je zakonodaja na tem področju bistveno izboljšala.

Title:ANALYSIS OF RECRUITMENT PROCESS OF RESIDENTS FROM FORMER YUGOSLAVIA
Abstract:
This bachelor’s thesis highlights the problems of recruiting residents from former Yugoslavia in the Republic of Slovenia (RS hereinafter). In the thesis, we present regulations in the RS and provide a description of the procedures and criteria that must be met by foreigners in case they want to obtain a residence and work permit. We go on to portray the influence of the European Union’s (EU hereinafter) directives on the regulations of the recruitment of foreigners in the RS. We studied the most common barriers to the employment of foreign residents in the RS with the help of a survey conducted among employers recruiting foreigners and their answers to the survey. Analysing the Employment, Self-employment and Work of Foreigners Act, we determined the main changes as well as advantages and disadvantages in the field of recruitment of foreigners. Using the conducted survey, the comparative method as well as the normative and descriptive method, we either confirmed or rejected the hypotheses stated in the introduction of the bachelor’s thesis. We used the comparative method to compare the former and the current legislation and studied whether the Slovene regulations comply with the EU’s directives in the field of recruitment of foreigners in the RS. The process of obtaining the residence and work permit has changed; the permit can be acquired more quickly than before the adoption of the new legislation in 2015. However, there are still some administrative barriers that prolong the process for at least a month. What is more, foreigners are uncertain about the submission of attachments and applications for obtaining a uniform permit, they face many bureaucratic barriers and have to deal with uncoordinated administrative units. This bachelor’s thesis shows that there are still problems regarding recruitment of foreigners in Slovenia; however, the legislation has undergone some thorough changes.
