Direktiva 2012/29/EU o določitvi minimalnih standardov na področju zaščite žrtev kaznivih dejanj in njena implementacija

Magistrsko diplomsko delo podrobno obravnava pomemben, pravno zavezujoči dokument, Direktivo 2012/29/EU Evropskega parlamenta in Sveta z dne 25. oktobra 2012, ki vsem osebam, ki spadajo pod definicijo žrtve kaznivega dejanja, zagotavlja minimalne standarde na področju njihovih pravic, podpore in zaščite, ki jih morajo države članice EU ustrezno implementirati v svoje nacionalne zakonodaje. V uvodu magistrske naloge sta predstavljena zgodovina in razvoj pravic žrtev kaznivih dejanj, na kratko je obravnavan tudi Okvirni sklep 2001/220/PNZ ter njegova implementacija, ki predvsem zaradi presplošnih določb in njihove nezavezujoče narave, ni bila zadovoljiva. V drugem delu magistrske naloge je vsebinsko predstavljena Direktiva 2012/29/EU in njene najpomembnejše določbe, zadnji del magistrske naloge pa je namenjen implementaciji Direktive o pravicah žrtev v slovenski pravni red ter presoji ustreznosti predvidenih rešitev, ki jih v slovenski Zakon o kazenskem postopku prinaša novela ZKP-N.

Abstract

The Master's Thesis deals in detail with an important, legally binding document, Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012, which provides for all persons, falling under the definition of a crime victim, minimum standards in the field of their rights, support and protection, that the EU Member States must properly implement in their national legislation. Introduction of the master's thesis presents history and development of the rights of victims of crime, and briefly discusses the Framework Decision 2001/220/JHA and its implementation, which was unsatisfactory, due to the general provisions and their non-binding nature. In the second part of the master's thesis, Directive 2012/29/EU and its most important provisions are presented in substance, while the last part of the master's thesis discusses implementation of the Victims’ Directive into Slovenian legal order and assesses the appropriateness of the provided solutions in the Slovenian Criminal Procedure Act by the ZKP-N amendment.
