The emphasis of my master thesis was on regulations of sports organizations from the European area, where they are obliged to follow the World Anti-Doping Code and on regulations of sports organisations in the USA, where they are not obliged to the same rules, but rather adopt their own. The main question that fueled my main thesis was: Why do the same violations of anti-doping rules result in different sanctions when comparing those two systems? The next logical question arose: Could the specifics of each system lead to the conclusion that such actions could be regarded reasonable and proportionate for each one of them? Further on I focused on a detailed comparative legal assessment of two specific regulations, which most accurately represented each system. Those are the NBA, representing the US cartel system and EuroLeague, representing the European pyramid system. Finally by means of the proportionality test my goal was to estabilsh if each of the specific systems with their respective sanctions regarding their objectives and taking into account the specifics brought forward for the NBA and the EuroLeague regulations were proportionate and justifiable.
