Abstract
Sklenjeno delovno razmerje predstavlja skupek pravic in obveznosti, ki so prisotne v razmerju delavca in delodajalca. Predpostavlja se vzajemno spoštovanje pravic in obveznosti. Odškodninska odgovornost v delovnem pravu predstavlja pomemben institut, s katerim je mogoče sanirati nastale škodne posledice, ki nastanejo v zvezi z delom ali na delu. Škodne posledice lahko nastanejo tako zaradi ravnanja delavca kot tudi zaradi ravnanja delodajalca, posledično pa to lahko pomeni tudi njuno odškodninsko odgovornost. V svojem delu sem se osredotočila na temeljne elemente splošne odškodninske odgovornosti v povezavi z delovno zakonodajo. Moje magistrsko delo je namenjeno predvsem predstavitvi osnovnih elementov odškodninske odgovornosti delavca in delodajalca, predstavitvi določenih posebnosti, predvsem pa skozi sodno prakso prikazati dojemanje škodnih dogodkov in izpostavitev posebnosti pri presoji konkretnih primerov.

Title:Employee’s and Employer's Liability for Damages
Abstract:
An employment relationship represents rights and obligations which are present between employee and employer, which represent mutual respect. Liability for damages in labour law presents an important institute to remedy negative consequences concerning work. Negative consequences can be present either on employee’s or employer's side, for which both can be liable. In my dissertation I focused on core elements of civil liability in connection with employment law. My dissertation aims to present core elements of employee’s and employer’s liability, with some special characteristics included, mainly through case-law and courts perception of some loss events.
