Abstract
Imenovanje sodnikov v sodnem svetu kot neodvisnemu organu je eden od različnih v praksi uveljavljenih načinov postavljanja sodnikov na sodniško funkcijo. Gre za novejši model, ki pa ima podlago v mednarodnih dokumentih, saj naj bi sodni svet s svojo sestavo in pristojnostmi zagotavljal sodelovanje med sodno oblastjo z drugima dvema vejama oblasti ter krepil sodniško neodvisnost in samostojnost sodstva. Hkrati naj bi se z imenovanjem sodnikov v sodnem svetu izognili političnim vplivom v postopku potrditve izbranih kandidatov za sodnike, ki naj se izbirajo zgolj po strokovnih merilih. S članstvom predstavnikov zakonodajne in izvršilne veje oblasti v samem organu sodnega sveta ali s sodelovanjem teh oblasti pri oblikovanju njegove sestave pa naj bi se preprečile situacije, ko se sodstvo organizira samo znotraj ozke skupine ljudi brez zunanjih vplivov. Sistem, v katerem sodnike imenuje sodni svet sam, je uveljavljen v Italiji, na Hrvaškem, v Španiji, na Portugalskem, v Makedoniji in v Bolgariji. Te ureditve na različne načine zagotavljajo uresničitev demokratičnosti, v glavnem z zagotavljanjem članstva v svetu tudi šefu države, kar omogoča neposreden vpliv izvršilne oblasti, ter sodelovanjem parlamenta pri volitvah ostalih članov sveta. V kolikor je zagotovljena primerna zastopanost članov tako, da sodniki ohranijo večino, lahko govorimo o dobro zastavljenem sodnem svetu s primernim obsegom pristojnosti, ki naj kandidate za sodnike izbira na podlagi vnaprej določenih strokovnih kriterijev.

Title:Appointment of Judges in Judicial Council
Abstract:
Appointment of judges in judicial council as an independent body is just one of the models of placement judges on judicial office. It is a new model, which has, however, his ground in international documents, because judicial council should ensure cooperation between the judicial power and second two branches of government, and it should strengthen judicial independence and judicial autonomy. Besides that, we shall avoid political influences in procedure of confirmation of chosen candidates for judges, that let be chosen only round professional criteria, with appointment of judges in judicial council at the same time. Situations shall be made impossible with membership of representatives of legislative and executive branch of government in alone body of judicial council or with cooperation of these powers at formation of his composition, when judicial power is organized without outside influences only inside narrow group of humans. System, that judicial council names judges alone in, is exercised in Italy, Croatia, Spain, Portugal, Macedonia, and Bulgaria. These law systems are ensuring realization of democracy on different manners, mainly with ensuring of membership in council also the president of a state, which enables direct influence of executive power, and cooperation of parliament at the election of remaining members of council. If appropriate representation of members is ensured like this, that judges keep majority, we are talking about well-established judicial council with appropriate scope of competence, that he is choosing candidates for judges based on in advance certain professional criteria.
