Abstract
Patentna sistema v Evropi in v ZDA predstavljata dva velika patentna sistema, ki sta si podobna, a kljub temu zelo različna. Magistrska diplomska naloga želi prikazati kateri patentni sistem je boljši, v pogledu izumitelja in tako primerja vse pomembne značilnosti patentnih sistemov, t.j. definicija patenta, pogoji patentabilnosti, sestavine patentne prijave, postopek pridobitve patentnega varstva, trajanje patentnega varstva, stroški ter razne posebnosti glede na patentni sistem. Predmet obravnave so predvsem sistemi znotraj območja EU (t.i. evropski patentni sistem) - nacionalna pot, evropska pot, mednarodna pot in kombinirane poti ter primerjava le teh in nato še obravnava ameriškega patentnega sistema in na koncu primerjava teh obeh velikih sistemov.

Title:The Present Patent System in the EU and USA - a comparative view
Abstract:
Patent systems as in Europe and USA, are one of the largest patent systems, which are very similar, but very different. The master thesis aims to present which patent system is better, in terms of the inventor. Thus comparing the important features of both patent systems, i.e. definition of the patent, the conditions of patentability, the content of the patent application, the grant procedure, the duration of the patent protection and costs and various features of each and both patent system. The subject matter of the discussion is, in particular, the systems within the territory of EU system (national route, european route, PCT route and combinated routes) and a comparison of these. Following, the discussion about USA patent system and ultimately, comparing these two large patent systems.
