Abstract
Z vzpostavitvijo evropskega notranjega trga se je pojavila potreba po pravni ureditvi zelo specifičnega problema, ki so jo na evropski ravni rešili s posebnim varstvom in nadzorom prometa s kulturnimi dobrinami v Evropski uniji. Kljub temu, da se je pravna ureditev vračanja predmetov kulturne dediščine spopadla s tako zelo ozkim okvirjem, je to pripeljalo do zelo močnih učinkov na nacionalne pravne sistem, predvsem na zasebnopravnem področju oziroma, še bolj natančno, na nacionalne ureditve stvarnega prava. Ti učinki pa so pripomogli k soustvarjanju sicer še zelo nekonsistentnega in fragmentarnega evropskega stvarnega in s tem tudi evropskega zasebnega prava kot celote.

Title:The return of cultural objects and European Private Law
Abstract:
With the creation of European Internal Market arose the need to regulate a very specific problem, which was solved at European level through a special protection and control of traffic of cultural objects in the European Union. Despite the fact that the legal system of returning the cultural objects has been tackled with such a narrow legal framework, this eventually lead to a strong effect on the national legal systems, especially in the area of private law, more precisely on the the national legislation of property law. These effects have also contributed to the co-creation of a very inconsistent and fragmented European Property Law and European Private Law as a whole.
