The master thesis begins with brief development introduction of the institute through the history, beginning with regulations in Roman law. Further on follows the introduction of current regulation in Slovenian legal order with conditions that have to be fulfilled for a successful process. Through the thesis are especially exposed some questions that appeared in judicial practice and are not yet finally solved in legal theory. Next follows introduction of the time limit for initiating proceeding of actio Pauliana, especially its crucial starting point. In this chapter is also presented legitimation and effect of the institute on each legal party. At the end of the master thesis are outlined some similarities and differences between fraudulent conveyance outside bankruptcy and fraudulent conveyance in a bankruptcy procedure, and exposed some comparable institutes from Slovenian legal order.
