Analiza postopkov urejanja in registriranja nepremičnin v sistemu zemljiške administracije v Sloveniji : magistrsko delo

V magistrski nalogi so predstavljeni rezultati analize sistema zemljiške administracije v Sloveniji. Podatkovni del sistema zemljiške administracije predstavljajo v Sloveniji tri temeljne zemljiške evidence: zemljiški kataster, kataster stavb in zemljiška knjiga. V prvem delu raziskave smo pregledali zakonodajni okvir, kjer smo predstavili tudi nekatere zakonske spremembe, proučili postopke v sistemu zemljiške administracije, ki so potrebni, da se nepremičnina vpiše v javno evidenco pri državni geodetski službi in v zemljiško knjigo, pregledali smo vsebine javnih nepremičninskih evidenc in opisali postopke, kako do podatkov v javnih evidencah dostopamo. V drugem delu smo analizirali podatke javnih nepremičninskih evidenc za izbrane nepremičnine. Za študijo primerov smo izbrali bazo nepremičnin, ki je v lasti izbrane gospodarske družbe. Seznam nepremičnin, ki ga ima gospodarska družba, smo dopolnili s podatki iz javnih evidenc in pregledali stanje nepremičnin. Na ta način smo poskušali oceniti »urejenost« oziroma pravilnost podatkov nepremičnin gospodarske družbe v javnih evidencah geodetske uprave in zemljiške knjige ter vzroke za neskladja.

• Title: The analysis of real property registration procedures within the land administration system in Slovenia

Abstract

Master's thesis presents the results of an analysis of land administration in Slovenia. The data part of the system of land administration in Slovenia represents three basic land records: land cadastre, building cadastre and land registry. In the first part of the thesis we examined the legislative framework where we presented some legal changes, studied processes in the system of land administration that are necessary for real estate registration, we reviewed the content of public real estate registration and described the procedures how to access data in public records. The practical part of the thesis contains analysis of the data from the public registry.For the case study we selected real estate from chosen company and we formed list of real estate. This list we filled with data from public registry. We examined the regulation for each type of the real estate. Our analysis was done for plots, building and part of the building. In thesis we tried to assess how data from the public registry is consistent with each other.
