ANALIZA POMENA NAČELA MATERIALNE RESNICE V SOCIALNIH ZADEVAH

V upravnopravnih razmerjih se na eni strani z upravnim postopkom uresničujejo javne politike, na drugi strani pa oblikuje regulatorni okvir upravnih postopkov za zaščito šibkejših posameznikov in družbenih skupin v razmerju do oblasti. Osnovni razlog posebnega urejanja postopkov uveljavljanja pravic socialne varnosti je omogočiti lažje in hitrejše uveljavljanje le teh. O pravici ali obveznosti praviloma odloča pravna oseba javnega prava. V socialnih zadevah so to nosilci socialnega zavarovanja ali centri za socialno delo, redkeje odloča organ neposredne državne oblasti. Magistrsko delo obravnava področje prava socialne varnosti z vidika uporabnosti načela materialne resnice v socialnih zadevah. V magistrskem delu je obravnavana tako sama vsebina načela kot tudi vse tiste temeljne faze postopka, v katerih pride uporaba takšnega načela do izraza. Osrednji del magistrskega dela je razmejitev upravnega postopka v socialnih zadevah in socialnega spora. Osrednji predmet raziskave magistrskega dela je analiza zakonodaje v zvezi z načelom materialne resnice in opredelitev načela ter prikaz učinkovanja in možnosti uporabe načela materialne resnice. Raziskava magistrskega dela je potrdila, da se javni interes na socialnem področju odraža skozi varstvo socialno šibkejših družbenih skupin tudi tako, da upravičena oseba iz sistema socialne varnosti čim hitreje in lažje uveljavi pravice iz sistema socialne varnosti, ki so utemeljene z materialnim predpisom. Na temelju opravljenih razgovorov z udeleženci v socialnih sporih je bilo moč potrditi, da se načelo materialne resnice razteza na trditveno in dokazno ponudbo. V povezavi s tem načelo materialne resnice omejuje hitro odločanje o pravicah na področju socialne varnosti, vendar so zato odločitve bolj pravilne.

Izvleček

In administrative relations on the one hand public policies are being implemented through public administration and on the other hand they formulate a regulatory framework for administrative procedures for the protection of weaker individuals and social groups in relation to the authorities. The basic reason for the special regulation of the procedures for exercising social security rights is to make it easier and faster to enforce them. The rule of law or obligations is generally governed by a legal entity governed by public law. In social matters these are social insurance institutions or centers for social work which are rarely decided by the authority of a direct state authority. The master's thesis deals with the area of social security law in terms of the applicability of the principle of material truth in social matters. The thesis also deals with the content of the principle as well as all those fundamental stages of the procedure in which the application of such a principle to the term is applied. The central part of the master's thesis is the delimitation of the administrative procedure in social matters and the social conflict. The main subject of the master's thesis is the analysis of the legislation in relation to the principle of material truth and the definition of the principle and the demonstration of the effect and the possibility of applying the principle of material truth. The research of the master's thesis confirmed that the public interest in the social field is reflected through the protection of socially weaker social groups also in such a way that the eligible person from the social security system, as soon as possible and easier to exercise the rights from the social security system, which are substantiated by the material regulations. On the basis of interviews conducted with participants in social conflicts it was possible to confirm that the principle of material truth extends to the assertive and evidential offer. In connection with this principle of material truth it restricts rapid decision-making on social security rights, but decisions are therefore more correct.
