There is an increasing interconnection between the environmental protection and public health field, which in order to achieve the goals of a healthy environment, requires tight inter-ministerial cooperation of agents working in those fields. The right to a healthy living environment is provided in Article 72 of the Constitution of the Republic of Slovenia, but due to the loose regulation, there are various interpretations of the scope and content of the right, which was formulated in a more detailed way through the case-law of the courts. A common opinion is that causing direct damage to human physical health as a result of harmful environmental effects is always regarded as violation of the right to a healthy living environment. The problem; however, is the insufficient legal protection of the right and the difficulty of proving the causal link. The state cannot guarantee a healthy environment to everyone, but it is obliged to create conditions and possibilities to exercise this right. The tasks of the state in this field include the adoption of appropriate legislation and policies, effective action to preserve or improve the state of the environment, raising awareness and supervision.
