Abstract
Diplomsko delo obravnava problematiko izbrisanih na ozemlju Republike Slovenije. Za lažje razumevanje je na začetku opisan razpad SFRJ in osamosvojitev Slovenije. Z osamosvojitvijo Slovenije so se začele težave s pridobivanjem slovenskega državljanstva. Veliko državljanov Republike Slovenije je bilo izbrisanih iz registra stalnega prebivalstva in posledično jim je bilo odvzeto tudi slovensko državljanstvo. Z izbrisom je Republika Slovenija kršila njihove človekove pravice in temeljne svoboščine, natančneje je kršila njihove pravice do zasebnega in družinskega življenja, izobraževanja, pridobivanja lastnine, socialne in zdravstvene varnosti in dostopa do trga. Ljudje, ki so bili izbrisani, so v Republiki Sloveniji kar naenkrat živeli nelegalno in so se morali skrivati pred policijo, otroci niso mogli obiskovati izobraževanja. Zaradi izbrisa, ne sodelovanja in neodzivnosti različnih ustanov pri ponovnem pridobivanju slovenskega državljanstva, so se izbrisani pritožili. Poznan sodni primer izbrisanih v Sloveniji je Kurić in drugi proti Sloveniji, kjer je Evropsko sodišče za človekove pravice odločilo v njihovo korist in ugotovilo, da je Republika Slovenija odgovorna za kršitev njihovih človekovih pravic in temeljnih svoboščin. Ustavno sodišče je dvakrat ugotovilo, da je bil izbris protipraven in neustaven, vendar slovenska oblast tega dolgo ni hotela priznati, v to je Republiko Slovenijo prisilil šele Velik senat Evropskega sodišča za človekove pravice, ki je ugotovil, da je pri izbrisu prišlo do zelo hudih kršitev človekovih pravic. Slovenska oblast je zato spremenila zakonodajo za odpravo posledic izbrisa. V novi zakonodaji se je osredotočila le na finančno odškodnino izbrisanim, pozabila pa je na težave, ki jih je posameznikom prinesel izbris iz registra državljanov Republike Slovenije.

Title:LEGISLATIVE REGULATION OF RIGHTS OF THE ERASED
Abstract:
The diploma paper discusses the issue of the erased on the territory of the Republic of Slovenia. In the beginning, the break-up of the SFRY and Slovenia's independence are described for easier understanding. With the independence of Slovenia, the difficulties with obtaining Slovenian citizenship began. Many citizens of the Republic of Slovenia were erased from the Register of Permanent Residents and were consequently deprived of their Slovenian citizenship. With the deletion the Republic of Slovenia has violated their human rights and fundamental freedoms, more precisely their rights to private and family life, education, property, social and medical safety, and market access. People who were erased, suddenly lived in the Republic of Slovenia illegally and had to hide from the police; the children were not able to attend education. Because of the deletion, non-cooperation and unresponsiveness of different institutions in the re-acquisition of Slovenian citizenship, the erased appealed. A known case of the erased in Slovenia is Kurić and Others v. Slovenia, where the European Court of Human Rights decided in favour of the erased and found that the Republic of Slovenia is responsible for the infringement of their human rights and fundamental freedoms. The Constitutional Court has twice found that the deletion was unlawful and unconstitutional, but for a long time the Slovenian authority did not want to admit it; the Republic of Slovenia was forced to do so by the Grand Chamber of the European Court of Human Rights, which found that the deletion resulted in very serious human rights violations. The Slovenian authority therefore changed the legislation to eliminate the consequences of the deletion. In the new legislation it focused on the financial compensation to the erased, but forgot on the problems that individuals had because of the deletion from the Register of Permanent Residents of the Republic of Slovenia.
