Abstract
Razumevanje pravice do zasebnosti je vezano na okoliščine konkretnega primera ter zasebnost kot vrednoto, zato se pravica do zasebnosti spreminja. Zaradi tehnološkega razvoja je za ohranjanje ustrezne ravni zasebnega v družbi med drugim nujna tudi pravna regulacija. Z vseprisotnostjo informacijskih tehnologij se razprava o zasebnosti osredotoča na informacijsko zasebnost, v povezavi s katero trenutno prevladuje teorija posameznika kot nadzornika osebnih podatkov. Pričakovati je, da se bo predmetna teorija v prihodnje spremenila tako, da bo priznana ustrezna pravna veljava vplivu na druge družbene skupine in celotno družbo, kar bo vidno predvsem na primeru prostovoljnih izgub zasebnosti in posmrtnega varstva zasebnosti.

Title:Understanding of the right to privacy; An attempt of defining the concept in legal theory
Abstract:
The understanding of the right to privacy is linked to the circumstances of an actual case and to privacy as a value. For this reason, the right to privacy is subject to changes. Due to technological development, it is necessary, inter alia, to use legal regulation in order to sustain the appropriate level of privacy in the society. The ubiquity of information technology results in legal discussions focusing on informational privacy, where the currently prevailing theory holds that the individual is the controller of his or her personal data. It can be expected that this theory will change in the future to give suitable legal value to the impact on other social groups and the whole society, which will be seen especially in the case of voluntary losses of privacy and posthumous privacy protection.
