Abstract
Posvojitev je skrajno sredstvo za zaščito interesov mladoletnih otrok, kadar ni mogoče pričakovati, da bodo biološki starši še kdaj lahko skrbeli za otroka. S posvojitvijo se otroku zagotovi trajno nadomestno skrb in emocionalno stabilnost. Med posvojiteljem in posvojenim otrokom se pravno vzpostavi enako razmerje kot med starši in otroki. V matičnem registu so posvojitelji vpisani kot posvojenčevi starši, ohrani pa se tudi podatek o otrokovih bioloških starših. Zaradi varstva osebnih podatkov je pravica do vpogleda v matični register in zbirke podatkov omejena. Brez pisne privolitve biološkega starša otrok nima pravice dostopa do njegovih osebnih podatkov, enako velja za dostop do osebnih podatkov otroka. Informacijska zasebnost je osebnostna pravica povzdignjena na raven temeljnih pravic. V sklop osebnostnih pravic je uvrščena tudi pravica do poznavanja svojega lastnega izvora, ki je odločilnega pomena za razvoj posameznikove osebnosti in izoblikovanje identitete. V postopkih, ki zadevajo otroke, je osnovno vodilo zagotavljanje največjih koristi otroka. Nasprotujoče osebnostne pravice se uravnoteži z omejitvijo nekaterih pravic. Predvideno soglasje za razkritje podatkov z možnostjo posredovanje podatkov, ki ne razkrijejo identitete bioloških staršev, vzpostavi ravnovesje med nasprotujočimi interesi.

Title:Protection of Personal Rights within the Adoption Procedure
Abstract:
Adoption is the ultimate means for protecting the interests of underage children when it cannot be expected that biological parents will ever be able to take care of the child. With adoption, permanent substitutional care and emotional stability can be ensured to the child. The same kind of legal relationship is established between the adoptive parent and the adopted child as between the biological parent and the child. In the civil register, the adoptive parents are entered as the adopted child's parents, but the data on the child's biological parents is also preserved. In order to protect personal rights, the right to check the civil register and the pertaining database is limited. Without written consent from the biological parent, the child has no right to access their personal information and the same rule applies to accessing the child's personal information. Information privacy is a personal right elevated to the level of fundamental human rights. Personal rights include the right to knowing one's family background, which is of decisive importance for the development of the individual's personality and formation of identity. The procedures including children are run on the basic premise of ensuring the biggest benefit for the child. The contradicting personal rights are balanced by limiting certain rights. The envisaged consent for disclosure of information with possibility of providing data without disclosing the identity of biological parents establishes a balance between the contradicting interests.
