Abstract
Dostop do informacij javnega značaja je izjemnega pomena za vsako sodobno demokratično državo, ki želi svojim prebivalcem in pravnim osebam ter pravzaprav vsem, ki jih zanima delovanje državnega aparata, zagotoviti preglednost njenega delovanja. Prav tako je pravica dostopa do informacij javnega značaja temeljna človekova pravica, ki v svetovnem merilu doživlja neverjeten razcvet. Informacije javnega značaja in varstvo osebnih podatkov obravnavata pomembni ustavno varovani človekovi pravici, ki sta tudi zelo povezani in se med sabo prepletata. Zakon o dostopu do informacij javnega značaja omogoča prost dostop ter uporabo vsakomur – ni nikakršnih omejitev. Prosto dostopne so pravnim ali fizičnim osebam. Zakon o varstvu osebnih podatkov pa določa, da je osebni podatek katerikoli podatek, ki se nanaša na posameznika, pri čemer mora biti posameznik določena ali določljiva fizična oseba. Zakon torej varuje samo tiste podatke, za katere vemo, kateri osebi pripadajo oziroma je ta oseba vsaj določljiva. Informacije javnega značaja in varstvo osebnih podatkov sta dve različni ustavni pravici, ki sta si v koliziji. Takšne vrste kolizij se razrešujejo v upravnem postopku.

Title:ANALYSIS PUBLIC INFORMATION AND PERSONAL DATA PROTECTION
Abstract:
Access to public information is of utmost importance to every modern democratic state that provides and guarantees its residents, legal persons and other interested subjects free access to public information and ensures transparency of its operations. The right to access public information is a fundamental human right gaining incredible prosperity worldwide. Access to public information and protection of personal data are enshrined in constitutions of many countries and are, therefore, constitutionally protected human rights that are closely related and intertwined with each other. According to Access to Public Information Act free access and use of public information is enabled to everyone, i.e. there are no restrictions. Public information is freely accessible to legal and natural persons. Personal Data Protection Act determines that personal data shall mean any data relating to an individual that must an identified or identifiable natural person. The Act, therefore, protects only data for which we know whom they belong to, or as stated by the law – the person must at least be identifiable.
