Alternativno reševanje sporov v postopku ureditve meje : diplomska naloga

Diplomska naloga predstavlja alternativne načine reševanja sporov pri urejanju meje. Mediacija je metoda alternativnega reševanja sporov, ki se običajno uporablja na sodiščih pri reševanju sporov iz gospodarskih, delovnih, družinskih in drugih civilnopravnih razmerij. V nalogi je opisan celoten proces ureditve meje v upravnem in nepravdnem sodnem postopku ter postopek ureditve meje z mediacijo, ki jo strankam ponudi sodišče. Naštete so prednosti mediacije in metode alternativnega reševanja sporov. Predstavljena sta Zakon o alternativnem reševanju sporov (ZARSS) in Zakon o mediaciji v civilnih in gospodarskih zadevah (ZMCGZ). Podrobno je opisan tudi postopek izvajanja mediacije pri Službi za alternativno reševanje sporov (SARS).

• Title: Alternative methods for dispute resolving at boundary determination procedure

Abstract

Graduation thesis represents the alternative method for dispute solving in the boundary determination procedure. Mediation is an alternative method for dispute resolving which is usually used in the courts for dispute resolving in commercial, employment, family and other civil-law relationships. The thesis describes the entire process in the boundary determination procedure in administrative and non-judicial proceeding and the proceeding with mediation which is offered by the court. There are listed the advantages of mediation and alternative method for dispute resolving. The Law of alternative method for dispute resolving (ZARSS) and the Law of mediation in civil and commercial matters are presented (ZMCGZ). There are also described the process of implementation of mediation in the Office for alternative method for dispute resolving (SARS).
