Cerkev/država : ločitev ali razločitev?

Ker odnosi med državo in verskimi skupnostmi pri nas niso urejeni, je konflikt s Cerkvijo (RKC) še bolj izrazit. Kako realizirati abstraktno ustavno normo o ločitvi verske od posvetne sfere je problem, ki je v tem prispevku obravnavan z dveh vidikov. Prvi vidik je navajanje razlogov za prakticiranje ločenosti, se pravi, vsebinsko utemeljevanje tega, zakaj to načelo sploh potrebujemo. Drugi vidik pa je sama izvedba načela. Čeprav sta obe vprašanji med sabo povezani, nista isti. Avtor zagovarja stališče, da je konsenz okrog drugega vprašanja možen, okrog prvega pa ni verjeten. Zato ni vseeno, kateri vidik (argumentacije) bo prevladoval v javni razpravi, ki bo potrebna za realizacijo omenjenih ustavnih določil. V drugi polovici prispevkaje predstavljena tipologija načinov (raz)ločitve in potrebni pogoji, da se uskladimo o izbiri enega izmed njih.

Abstract

The relations between the state and the religious communities are not settled in Slovenia. As a consequence, the conflict with the Roman Catholic Church is even more pronounced. The author deals with the problem of how to implement the abstract constitutional norm on the division of the religious sphere and the secular one, from two aspects. The first one is defining the reasons for implementation of the division, that is, the substantiation of the use of this principle. The second one deals with the very implementation of the principle. Although both are interconnected, they are not the same. The authorspeaks in favour of the viewpoint according to which the consensus about the second question is possible, while the consensus about the first one is not likely. Therefore, it is importante which aspect (of the argumentation) will prevail in the public debate, necessary for the implementation of the above mentioned constitutional provisions. The second part of the article presents a typology of the ways of distinction/division, and the necessary conditions for the harmonisation of opinions on the choice of one of them.
