The right to know one's origin is guaranteed to individuals by international legal acts that bind the Republic of Slovenia. It has the nature of a fundamental human right and is recognized as part of the constitutional right to personal identity and the constitutional right to respect for private and family life.
The mechanisms and legal remedies that enable individuals to effectively exercise this right must be effectively regulated at the statutory level. The factual and legal situations in which an individual’s question regarding their origin arises, and in which appropriate legal remedies must be provided and ensured for the realization of this right, include adoption and the determination of parenthood (recognition, contestation, and establishment of parenthood, as well as determining parenthood in children conceived through biomedical assistance).
The regulation of the right to know one’s origin in the Republic of Slovenia largely ensures its effective implementation, but certain areas deviate from established standards and the requirements of international legal acts, as well as the case law of the European Court of Human Rights.
