Abstract
Delovna zakonodaja se s prožnostjo trga dela prilagaja spreminjajočim se potrebam gospodarstva in družbe, ki vse bolj sledita ideji uravnoteženosti zasebnega in poklicnega življenja. Del tega je tudi ureditev organizacije, razporeditve in dolžine delovnega časa. V nalogi se ukvarjam z možnostjo zmanjševanja delovnih ur v okviru polne zaposlitve, ki je trenutno omejena z minimalno 36 in maksimalno 40 urami tedensko. Ker v Sloveniji poznamo nekaj podjetij, ki takšno obliko dela ponujajo, sem preučila delovnopravno zakonodajo, ki ureja delovni čas, da bi ugotovila, na kakšen način, če sploh takšno obliko krajšega delovnega časa omogoča. Naletela sem na več izzivov, ki zadevajo tako delovnopravno kot tudi pokojninsko zakonodajo. Da bi ugotovila, kako se v praksi takšna razmerja urejajo, sem izvedla intervjuje z dvema institucijama s področja trga dela in enim podjetjem, ki je uvedlo krajši delovni čas. Ugotovila sem, da gre za prilagoditve, ki temeljijo na organizaciji delovnega časa, ki delno odstopajo od slovenske zakonodaje s tega področja. Ocenjujem, da delovnopravna in socialna zakonodaja nista v celoti prilagojeni potrebam delodajalcev, ki bi zaposlenim želeli ponuditi krajši delovni čas, hkrati pa jim zagotoviti polni obseg delovnih in socialnih pravic.

Title:
The reduction of working time: challenges and opportunities from practice and Slovenian labour legislation
Abstract:
Labor legislation is adapting to the changing needs of the economy and society by promoting a balance between private and professional life through the flexibilization of the labor market. Part of this involves the regulation of the organization, distribution, and duration of working hours. This thesis explores the possibility of reducing working hours within the framework of full employment in Slovenia, which is currently limited to a minimum of 36 and a maximum of 40 hours per week. Given that there are some companies in Slovenia that offer this form of work, I examined labor legislation governing working hours to determine if it is flexible enough to allow for a reduction in working hours. I encountered several challenges related to both labor and pension legislation. To understand how such arrangements are managed in practice, I conducted interviews with two labor market institutions and one company that has implemented reduced working hours. I have noted that these are adjustments based on the organization of working time, which partly diverge from Slovenian legislation in this field. I conclude that labour and social legislation is not fully adapted to the need of enterprises wishing to offer employees shorter working hours, while at the same time guaranteeing the full range of labour and social rights.
