Abstract
Z osebnimi podatki se srečujemo vsakodnevno, ne da bi se tega zavedali. Zadnja leta so zaradi razvoja tehnologije in ostalih okoliščin osebni podatki vse bolj izpostavljeni nevarnosti. Pravni režim ravnanja z osebnimi podatki ureja Splošna uredba o varstvu podatkov, ki je v uporabi od leta 2018, v Republiki Sloveniji pa to uredbo dopolnjuje Zakon o varstvu osebnih podatkov (ZVOP-2), sprejet konec 2022. V diplomskem delu so preučevane pravice posameznikov do zasebnosti, temeljni predpisi ter bolj podrobno temeljna načela, ki so urejena v notranjem pravu. Prav tako je predstavljena problematika, ki se pojavlja pri dostopu in obdelavi osebnih podatkov. Uporabljena je primerjalna metoda med ZVOP-2 in GDPR, njihove prednosti, slabosti ter novosti, zraven pa je vključena tudi uporaba ZUP-a. Za rešitev problematike in dileme sta zastavljeni dve raziskovalni vprašanji, ki bosta podrobneje opredeljeni. Pri prvem raziskovalnem vprašanju je ugotovljeno, da je GDPR strožji zakon, ki velja za celotno Evropo. Razlika je v tem, da GDPR nima vpliva na specifične postopke v posamezni državi, ZUP pa velja samo, ko gre za upravne postopke. Pri drugem raziskovalnem vprašanju je ugotovljeno, da oba organa upošte-vata varstvo osebnih podatkov na visokem nivoju, kar za javnost pomeni, da se lahko zanese na organe, saj upoštevajo predpisane zakonodaje, kar posledično prinaša ko-rist za posameznika. Koristno bi bilo, če bi se javnosti predstavili tako organi, kot pod-jetja ter njihovi načini varovanja osebnih podatkov, prav tako naj bi potekala izobraže-vanja glede pravic posameznikov in o novostih na tem področju.

Title:Analysis of data protection issues in the selected administrative authorities
Abstract:
We are confronted with personal data on a daily basis without even realising it. In re-cent years, due to the development of technology and other circumstances, personal data have been increasingly put at risk. The legal regime for the handling of personal data is governed by the General Data Protection Regulation, which has been in force since 2018, and in the Republic of Slovenia this regulation is supplemented by the Personal Data Protection Act (ZVOP-2), adopted at the end of 2022. In my thesis, the privacy rights of individuals, the tele-material regulations and, in more detail, the fundamental principles regulated in domestic law are examined. It also pre-sents the issues that arise in the access to and processing of personal data. A compa-rative method between the GDPR and the GDPR, their advantages, disadvantages and novelties is used, and the application of the PDPA will be included. In order to solve the problem and the dilemma, two research questions are posed and will be defined in more detail. For the first research question, it is noted that the GDPR is a stricter law that applies to the whole of Europe, while only to Slovenia. The diffe-rence is that the GDPR has no impact on country-specific procedures, whereas the PDPA only applies when it comes to administrative procedures. The second research question notes that both authorities respect the protection of personal data at a high level, which means that the public can rely on the authorities as they comply with the prescribed laws, which in turn brings benefits to the individual. In future, I think it would be good to highlight both authorities and companies and their ways of protecting per-sonal data, as well as to provide training on the rights of individuals and subsequent innovations.
