Postopek posvojitve v okviru novega Družinskega zakonika skozi izkušnje strokovnih delavk : magistrsko delo

Leta 2019 se je na področju posvojitev pričel uporabljati Družinski zakonik. V svojem magistrskem delu predstavljam izkušnje strokovnih delavk ob zamenjavi zakonodaje. V izvedeni študiji primera sem se osredotočila na to, kako je sprememba zakonodaje vplivala na delo strokovnih delavk v postopkih posvojitve in kakšnih priprav so bile deležne strokovne delavke zaposlene na področju posvojitev. Zanimalo me je, katere priložnosti je Družinski zakonik odprl ter s katerimi ovirami ali dilemami so se strokovne delavke soočale ob pričetku uporabe novega Družinskega zakonika na področju posvojitev ter katere prednosti in slabosti spremembe zakonodaje na področju posvojitev izpostavljajo. Zanimalo me je tudi, kakšno je sodelovanje med sodišči in centri za socialno delo ter njihovimi strokovnimi delavci. Na podlagi rezultatov ugotavljam, da se postopek posvojitve kljub skrajšanju zakonsko predpisanega roka ni skrajšal, da potrebnega sodelovanja in komunikacije med sodišči in centri za socialno delo ni, ob tem pa je zam

• Title: The adoption process by the new Family Code through the experience of professionals

Abstract

In 2019, the Family Code began to be applied in the field of adoptions in Slovenia. In my master's thesis, I present the experiences of social workers during the change of legislation. In the conducted case study, I focused on how the change in legislation affected the work of social workers in adoption procedures and what preparations they had. What opportunities the Family Code opened up and what obstacles or dilemmas did social workers face when the new Family Code was applied in the area of adoptions, and what advantages and disadvantages of the change in legislation in the area of adoptions do they highlight. I was also interested in the cooperation between courts and centers for social work and their professionals. Based on the results, I conclude that the adoption process has not been shortened, despite the shortening of the statutory deadline.
