Izbrisani in njihov boj na sodišču : magistrsko delo

Datum 26. 2. 1992 je bil prelomen za 25.671 ljudi, ki so bili s strani Ministrstva za notranje zadeve izbrisani iz registra stalnega prebivalstva Republike Slovenije. Država je prebivalcem, ki so imeli na dan odcepitve, 25. 6. 1991, v Republiki Sloveniji stalno prebivališče, dala pravico, da v šestih mesecih oddajo vlogo za državljanstvo. Številni vloge v tem času iz različnih razlogov niso oddali, nekateri so jo oddali in je bila njihova vloga zavrnjena ali zavržena. Vsem tem prebivalcem je bil odvzet status stalnega prebivalstva, imenovan izbris. Nekateri izmed izbrisanih prebivalcev so se po dolgih letih iskanja načina pridobitve državljanstva Republike Slovenije odločili, da se na sodišču podajo v boj za odškodnine zaradi posledic, ki jim jih je pustil izbris. Na poti raziskovanja sem prišla do oseb, ki si v boj z državo iz različnih razlogov niso upale ali za to niso imele finančnih sredstev, kot tudi do oseb, ki so tožbe vložile. Pogovor z vsako od teh oseb je prinesel individualne zaključke postopkov kot tudi individualna razumevanja samega izbrisa.

• Title: The Erased and their battle in court

Abstract

February 26, 1992 was a turning point for 25,671 people who were deleted from the permanent population register of the Republic of Slovenia by the Ministry of the Interior. The state gave residents who had a permanent residence in the Republic of Slovenia on the day of secession on 25 June 1991 the right to submit an application for citizenship within six months. Many did not submit an application during this time for various reasons, some did and their application was rejected or dismissed. All these residents were deprived of their permanent population status, called erasure. After many years of searching for a way to obtain citizenship of the Republic of Slovenia, some of the erased residents decided to go to court to fight for compensation for the consequences of the erasure. On the way of research, I came across people who, for various reasons, did not dare to fight with the state or did not have the financial means to do so, as well as people who filed lawsuits. The conversation with each of these persons brought individual conclusions to the procedures as well as individual understandings of the erasure itself and its consequences.
