Abstract
To magistrsko delo obravnava vpliv identitet na uresničevanje človekovih pravic prek analize posebnega položaja, v katerem se znajdejo istospolni prosilci za azil. Ker magistrsko delo izhaja iz predpostavke, da je identiteta proizvod družbenega in političnega okolja, obravnava problematiko presečnih identitet istospolnih prosilcev za azil s pomočjo konstruktivističnega konceptualno-teoretskega okvirja. Magistrsko delo obravnava razvoj mednarodne zaščite prosilcev za azil LGBTQ+ in na primeru Nemčije pokaže, da se številni istospolni prosilci za azil soočajo s stereotipnimi postopki, ki temeljijo na diskriminaciji in nepravični oceni verodostojnosti. Uresničevanje človekovih pravic za pripadnike te manjšinske skupnosti je tako oteženo in v neskladju z mednarodnimi normami o človekovih pravicah.

Title:Sexual identity as an obstacle to the implementation of international human rights norms: the position of sexual minority members in the asylum process
Abstract:
This master thesis examines the impact of identity on access to human rights through an analysis of the specific situation of same-sex asylum seekers. Since the master thesis starts from the assumption that identity is a product of the social and political environment, it addresses the issue of intersectional identities of same-sex asylum seekers within a constructivist conceptual-theoretical framework. The master thesis examines the development of international protection for LGBTQ+ asylum seekers and uses the case of Germany to demonstrate that many same-sex asylum seekers face stereotypical procedures based on discrimination and unfair credibility assessment. Access to human rights for persons affiliating with this minority community is thus hindered and inconsistent with international human rights norms.
