Abstract
Magistrsko diplomsko delo obravnava zakonsko ureditev agrarnih skupnosti, vzpostavljeno z leta 2015 sprejetim Zakonom o agrarnih skupnosti. Na podlagi tega zakona se v Republiki Sloveniji registrirajo agrarne skupnosti oziroma skupnosti fizičnih in pravnih oseb, ki so bile ponovno vzpostavljene in organizirane na podlagi Zakona o ponovni vzpostavitvi ter vrnitvi njihovega premoženja in pravic. Na ta način registrirane skupnosti so po svoji pravni naravi sui generis družbe civilnega prava oz. societete, katerih notranja ureditev se na podlagi zakona približuje ureditvi pravnih oseb. Skozi prizmo organizacijske strukture agrarne skupnosti ter njenih organov vodenja in nadzora je predstavljen način delovanja oziroma upravljanja premoženja agrarne skupnosti. Zakon, kot specialni predpis vzpostavlja tako imenovani sistem upravljanja s premoženjem preko organov, kar v naravi pomeni odstop od ureditve upravljanja s solastnino oziroma skupno lastnino iz stvarnopravnega zakonika. Z določitvijo pravil dedovanja pa odstopa prav tako odstopa od zakonske ureditve dedovanja. Zakonska ureditev teh dveh področij, s posebnostmi in značilnostmi je s pomočjo pravne teorije in sodne prakse predstavljena v tem delu.

Title:Legal Regulation and Ownership in Agrarian Communities in the Republic of Slovenia
Abstract:
The master's thesis examines legal regulation of agrarian communities established by the Law on agrarian communities adopted in 2015. Following this legal title, agrarian communities or communities of natural and legal persons that have been re-established on the base of the Law on the restoration and return of their property and rights are being registered in the Republic of Slovenia. Communities registered according to the rules of Law on agrarian communities, are, by their legal nature, sui generis civil law societies or societates, whose internal organization, based on the law, resembles the regulation of legal persons. First part of this work presents internal organizational structure of agrarian communities and their governing and supervisory bodies. Second examines method of operation or management of agrarian community property. The law, as a special regulation, establishes the so-called property management system through organs, which in essence means a deviation from the regulation of co-ownership or joint ownership from the property law code. By determining inheritance rules, it also deviates from the legal regulation of inheritance. The legal regulation of these two areas, with their peculiarities and characteristics, is presented in this work with the help of legal theory and case law.
