Abstract
Motorna vozila se skladno s sodno prakso štejejo za nevarno stvar, zato je imetnik objektivno odgovoren za škodo, ki v zvezi z obratovanjem motornega vozila nastane tretjim osebam, torej tistim, ki v prometni nesreči niso udeleženi kot imetniki motornih vozil. Magistrsko diplomsko delo skozi sodno prakso analizira možnost razbremenitve objektivne odškodninske odgovornosti imetnika motornega vozila v cestnem prometu v razmerju do tretjih oseb. Med razbremenilne razloge spadajo višja sila, ravnanje oškodovanca in ravnanje tretje osebe. To ravnanje mora biti izključni vzrok za škodo; da se imetnik vozila lahko popolnoma razbremeni odgovornosti, pa mora biti tudi nepričakovano, posledice pa neizogibne ali nepreprečljive. Obligacijski zakonik omogoča tudi delno razbremenitev objektivne odškodninske odgovornosti, pri čemer je ta zaradi milejših pogojev v praksi pogostejša od popolne. Magistrsko diplomsko delo predstavi obe možnosti, pri čemer daje poseben poudarek ravnanju oškodovanca. Dodatno je obravnavana tudi razbremenitev odškodninske odgovornosti prevoznika za osebno škodo potnika, ki nastane pri njegovemu prevozu v cestnem prometu.

Title:Exemption from strict liability in traffic
Abstract:
According to case law, motor vehicles are dangerous goods. Therefore, in connection with the operation of the motor vehicle, its keeper is strictly liable for damage caused to third parties, i.e. those who are not involved in the accident as keepers of a motor vehicle. The master's thesis analyses, through case-law, the possibility of exemption from the keeper's strict liability for damages in road traffic in relation to third parties. The grounds for exemption are force majeure and the action of the injured or third party. The latter must be the exclusive cause for damage, it must be unforeseen and the consequences unavoidable for the vehicle keeper to be fully exempt from liability. Obligations Code also allows for partial exemption from strict liability, which is more prevalent as the conditions are more lenient. The master's thesis presents both options, with particular emphasis on the action of the injured party. In addition, the exemption from liability of the carrier for damages arising from the carriage of passengers by road is discussed.
