The creditor-debtor legal relationship does not guarantee the creditor that he will achieve payment of his claim. The debtor may avoid payment, could be late with payment or refuse to fulfill the obligation. The presented legal instruments guarantee creditors that they can more easily and quickly achieve payment of their claims. In times of economic uncertainty and poorer payment discipline, these instruments are therefore more then welcome. Cession is the fundamental instrument of assignment of claims in civil law. The instruments of factoring and forfaiting are some kind of upgrade of cession, while assignment is a completely different legal relationship.
